C. Ordinance Amending Chs. 3.18 and 3.29 of the Kent City Code
Administration of Taxes — Adopt
Finance Director Paula Painter provided an overview of the Ordinance
amending Kent City Code 3.18 and 3.29.
The utility tax code has its own specific filing frequency in section 3.18.030 of
the Kent City Code, while the filing frequency for other taxes are controlled
by the Chapter 3.29 KCC. This ordinance will repeal the utility tax code
provision setting a monthly frequency, which will then subject utility taxes to
the generally applicable administrative tax code that has a default quarterly
filing frequency but provides the Finance Director discretion in determining
the optimal tax filing frequency.
This ordinance also clarifies that although tax information is generally
confidential and only disclosable under specific circumstances, as provided in
KCC 3.29.200, returns and tax information may be disclosed for collection
purposes.
Tax Manager, Andrea Madsen explained how penalties are calculated.
MOTION: I move to adopt Ordinance No. 4495, amending the
Kent City Code to align utility tax filing frequency with other
city taxes, and to clarify that tax information may be disclosed
for collection purposes.

D. INFO ONLY: 2024-2025 Insurance Program Update
Risk Manager, Ellaine Wi provided the Council with an update on the 2024-
2025 Insurance Program.
Wi indicated that policies for property liability, crime and fidelity liability, and
drone liability coverage renewed on July 1st
Wi explained the key elements of the renewal and provided an overview of
the Property Insurance Premiums from 2018- 2025.
Wi explained the graph of catastrophe events 1980-2024.
Average premium costs are trending downward since September 2023.
Wi provided an overview of the Property Program Structure and also detailed
upcoming renewals.
E. Resolution Supporting the Mill Creek Middle School Stormwater
Improvement Project - Adopt
Chief Economic Development Officer, Bill Ellis provided a recap of the
Resolution Supporting the Mill Creek Middle School Stormwater Improvement
Project that expresses the Council's support of a grant application.
MOTION: I move to adopt Resolution No. 2074 to support the
Mill Creek Middle School Stormwater Improvement Project and
authorize the Mayor to sign all necessary documents.

MOTION: I move to authorize the Mayor to sign an ARPA Grant
Agreement with the Kent School District, in an amount not to
exceed $460,000, subject to final terms acceptable to the
Economic and Community Development Director and City
Attorney.

G. City of Kent Courtroom Refurbishment Change Order —
Authorize
Interim Parks Facilities Superintendent, Nate Harper provided an overview of
the Change Order for the municipal court remodel project.
Harper responded to Council's questions regarding the prior change orders
and the estimated completion time of the project.
MOTION: I move to authorize the Mayor to sign Change Order
#6 with LBC Construction in the amount of $20,419.16, subject
to final terms and conditions acceptable to the City Attorney
and Parks Director.

H. Cooperative Purchasing Agreement with Panasonic Connect
North America - Authorize
Deputy Information Technology Director, Tara Duckworth, provided details
on the purchase of 145 mobile data computers for the Police Department.
The current computers are at the end of their hardware lifecycle.
The new laptops are portable and can be used in the police vehicle and at
their desktop.
MOTION: I move to authorize the IT Director to purchase
computer equipment through a cooperative purchasing
agreement with Panasonic Connect North America, through
June 30, 2025, or any extended contract term, if those
purchases are within the City's established budgets.

I. Association of Washington Cities Alternative Response Team
Grant Award - Authorize
Sergeant Landon Meyer presented information on the Association of
Washington Cities Alternative Response Team Grant Award.
This grant supports Kent's Project Be Free Program that assists law
enforcement in alternates to policing.
Meyer indicated this grant partially funds the program and if this grant is an
annual application, the Police Department will submit an application.
MOTION: I move to accept grant funds from the Association of
Washington Cities in the amount of $205,000 for the Domestic
Violence Co-Responder Program, amend the budget, authorize
expenditure of the grant funds, and authorize the Mayor to sign
the grant agreement, subject to final terms and conditions
acceptable to the Chief of Police and City Attorney.

J. Ordinance Authorizing Fiber Franchise with Ziply Fiber Pacific,
LLC - Introduce
Deputy City Attorney Christina Schuck provided an overview of the Ordinance
Authorizing a Fiber Franchise with Ziply Fiber Pacific, LLC.
This franchise is a contract authorizing the installation of fiberoptic network
facilities in the City right-of-way.
Ziply will offer high speed internet and expects to begin construction this Fall,
with service in early 2025.
Ziply is a local company expanding throughout Washington.
Schuck advised this is a 10-year franchise and reviewed some of the terms.
This Ordinance is being introduced during tonight's City Council meeting and

is anticipated to be adopted on August 6th.
MOTION: I move to introduce Ordinance No. 4496 at the July
16, 2024, City Council meeting, which if later adopted by
Council, will grant a non-exclusive 10-year franchise with Ziply
Fiber Pacific, LLC for the installation of a fiber optic network,
subject to final franchise terms and conditions acceptable to
the City Attorney.

K. Puget Sound Regional Council's Equity Pilot Grant for the
Benson Corridor Plan - Authorize
Transportation Planner, David Paine provided an overview of the Puget
Sound Regional Council Equity Pilot Program. The Program was created in
2022 to fund equity-focused, regional transportation investments to advance
a coordinated land use and transportation plan centered on the Benson
Corridor.
The 2021 Transportation Master Plan calls for a Benson Corridor Plan. The
two action alternatives for the Comprehensive Plan update detail enhanced
development along the corridor. Additionally, the City has a "Designated
Countywide Center" in the area around 104th Ave SE and SE 256th St.
Additional sub-area planning is needed to receive full certification.
The Benson Corridor Plan will provide visioning, policy, and next steps to
transform the four mile, north-south corridor into a more transportation
efficient community. The Plan will look for ways to provide more seamless
and comfortable connections. It will result in a ready-to-implement plan with
updated zoning, design standards, SEPA analysis, and capital planning
support. The project will be led by Economic & Community Development with
support from the Public Works.
MOTION: I move to accept grant funds from the Puget Sound
Regional Council's Equity Pilot Program in the amount of
$709,364 for completing the Benson Corridor Plan, amend the
budget, authorize the expenditure of funds, and authorize the
Mayor to sign all necessary documents, subject to final terms
and conditions acceptable to the Public Works Director and City
Attorney.

L. INFO ONLY: Summer 2024 Transportation Grants Update
Paine provided an overview of transportation grants.
Since January, the City has been notified of a number of successful awards
for candidate projects due to prior-year project calls.
There are two remaining transportation-related grant opportunities in 2024:
the Transportation Improvement Board Program, and Washington State
Department of Transportation Railway-Highway Crossings Program Section
130 grant.
Paine provided details on the projects.

Key Elements of Property Renewal
• This year's premium for property insurance is $1,088,467.68.
For this renewal period, there was a rate reduction of
-5.61%, and the total insurable value (TIV) of the City's
property increased ~+8.65% (by comparison, last year's
increase was ~6%). Overall, this year's premium increased
+2.33% over last year's premium.
