All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows: 1. In Amendment 1, Section 11.2 was modified to change how review hearings were compensated, but the total contract sum in Section 11.1 wasn't modified. 2. Section 11.1 of the Agreement, entitled "Case Fees" is hereby modified: The total fees and costs paid to the Contractor under this Agreement and throughout its term shall not exceed $215,000 $ 9 unless any such additional fees and costs are authorized through an amendment to this Agreement signed by both the City and the Contractor.
