All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows: 1. Section 3 of the Agreement, entitled "Duration," allows for an additional twenty-five- year extension of the Agreement. By executing this Amendment, the parties agree to renew the Agreement for this additional term. 2. Section 7 of the Agreement, entitled "Maintenance," is hereby modified to add additional provisions as follows: (c) Garbage Can Installation. The City will install and maintain 3 garbage cans along the eastern edge of the parking lot to assist with garbage generated by park patrons. (d) Weekly Sweeps. The City will make weekly checks of the east stalls and pick up trash left on the ground. (e) Signage. The City will maintain signage along the east edge of the parking lot indicating the stalls that are available for park use. Additionally, The City will provide two portable "A frame" signs to assist Trinity with keeping the lot closed to park patrons on Sundays. (f) Vegetation Maintenance. The City will maintain vegetation along the edge of the parking lot and keep the trees pruned to generally acceptable standards. 3. Exhibit A referenced in Section 2 of the Agreement, entitled "Property Description" is hereby replaced with Exhibit A attached hereto. The Parties accepts all requirements of this Amendment by signing below, by its signature waives any protest or claim it may have regarding this Amendment, and acknowledges and accepts that this Amendment constitutes full payment and final settlement of all claims of any kind or nature arising from or connected with any work either covered or affected by this Amendment, including, without limitation, claims related to contract time, contract acceleration, onsite or home office overhead, or lost profits. This Amendment, unless otherwise provided, does not relieve the Trinity Community Church from strict compliance with the guarantee and warranty provisions of the original Agreement. AMENDMENT - 1 OF 2 All acts consistent with the authority of the Agreement, previous Amendments (if any), and this Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed, and the terms of the Agreement, previous Amendments (if any), and this Amendment shall be deemed to have applied.
