In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

Due to an interference in the first 1 1/4" of the wall not all
areas could be fully scanned. A accurate scan could only be
achieved in areas where there was rebar present. Stay 1"off
rebar to avoid. Pipes, Conduits, and questionable objects are
marked in red. Stay 2" off Pipes, Conduits, and questionable
objects to avoid. Depths of objects are given when applicable.
Stay 1" above given depths to avoid. Recommend avoiding all
objects if at all possible. Recommend further investigation into
the make up of the wall that was scanned. Cannot collect
data 3" off walls or obstructions.
Disclaimer: Due to the nature of Slab on Grade scanning not
all objects can be guaranteed as found. Must saw cut at own
risk.

RE: RSE's additional costs associated with RFI#22 on the Kent Common Project
Good afternoon,Bryce
Just wanted to give a quick synopsis on the events and associated costs related to RFI#22 and SSk-02.
On Tuesday May 21,2024,RSE's two-man crew unloaded two scissors' lifts with other necessary support
equipment and two steel channels with hardware onto the Kent Common Project site. The crew began installing
the channels near the ceiling as per plans and specifications to reinforce an existing wall.
During the channel anchor bolt installation process RSE's crew discovered voids in the existing wall that were
designed to be solid.
RSE crew notified Boyces field supervision of the change of condition issue and since there was no quick fix for
wall voids,RSE crew removed the partially installed channel for safety concerns. Then the crew reloaded RSE's
small tools into the company truck to finish the shift. Basically,no meaningful contract work was completed other
than the discovery of the hidden voids in the wall.RSE paid the crew 16 hours for their time on the project.
RSE patiently waited for a timely engineered solution,thus RFI 22 was created. A couple of days passed with no
solution,RSE needed our two scissors lift to support our crew working on another project, and reloaded the idle
scissors lifts onto a trailer and moved the lifts to RSE's Woodinville project. Basically, RSE is now completely
mobilized off the site.
On May 25'2024 the design team issued an written solution but there was a constructability issues solution to
RFI 22 and additional time was required to determine the correct fix.
Today,June 17 RSE has determined it now believes we have the information to successfully install the channels
as to SSK#02.
To do so RSE now must remobilize with scissor lifts and additional plate material to complete the wall
reinforcement and requests monetary compensation for spent labor and mobilization fees along with the
additional material and labor(two men at 4hrs)to supply and install the new plate.Please see attached RFI
#22 cost summary for a total of$7,897.

01. Furnish and install masonry related scaffolding(NOT for use by the GC or other trades)on a compacted solid base provided by others. Scaffolding to be placed inside
or outside of structure at Mason's option.
02. Furnish and install joint reinforcement and masonry anchors(where applicable)per structural details.
03. Place loose reinforcing steel(G.C.to offset,pull and place in general area to be installed).
04. Furnish and place grout in masonry walls and H.M.frames(in masonry only)H.M.frames furnished and preset by others.
05. Furnish and install self-adhered thru wall flashing only(metal flashing by others.(See Page 2)).

02. Furnishing and/or installing anchor slots,templates,expansion bolts,buck or frame anchors,C channel,door frames,or any other miscellaneous metals.
03. Furnishing and/or installing copper fabric and sheet metal flashing;welding,saw cutting for reglets,attached or bolted angle iron.
04. Furnishing and/or installing pre-cast concrete,CIP concrete,furnishing and/or installing pavers,retaining wall blocks,splash blocks or manholes.
05. Wood forming temporary supports,shoring for lintels,soffits,or overhead masonry;bracing of walls.
06. Engineering and layout,grades:control lines,snap lines,wall lines,bench and grade marks,elevation and any other related layout requirements;including layout of
work specified in other divisions.
07. Sales tax, performance or payment bonds,permits,inspection,testing and related costs,eco pans and dumpsters for debris removal.
08. Furnishing and/or installing water repellents,damp-proofing,caulking,sealants,fire safing,non-shrink grout,dry-pack,backer rods,seismic joint covers,expandable
fillers,graffiti protection,building paper or any other form of vapor barrier.
09. This proposal includes completion of one punch list,additional punch lists will be billed accordingly for services and travel.
10. Furnishing and/or installing rigid insulation.
11. Concrete preparation,drilling,dowels,retrofitting or grouting of beam pockets,demolition,restoration,patching of existing masonry or toothing of infills.
12. G.C.shall provide structural design,shop drawings,as-built drawings,coordination drawings;and-conformed contract documents including two sets of paper drawings
not less than half scale.
GENERAL CONDITIONS and work required of others:
01. This bid is conditioned upon execution of an AGC of Washington Subcontract,2002 edition with no bond required and payment not contingent on owner payment and a
mutually acceptable schedule.The use of this proposal in the acquisition of a contract with any owner constitutes completed acceptance of the items and conditions of
this bid and shall become an attachment to the contract.
02. This bid is based on only one mobilization.Any additional will be charged accordingly.
03. G.C.will provide all-weather free access to work,a prepared compacted base for scaffold,traffic control,flagging and street cleanup related to subcontractor's work.
04. G.C.to furnish weather protection of all masonry(per W ISHA requirements)to include all cover,heat,cool,framework,as necessary to maintain project schedule
(other than covering walls at end of the day.)
05. G.C.to furnish temp.power and pressurized water(to be within 50 ft.of masons work area)and adequate lighting for masonry installation.
06. G.C.to furnish suitable hoist and operator for mason work over 35 feet or inaccessible by mason's forklift.
07. G.C.to cover openings to prevent water from entering building due to mason cleaning operation,if required.
08. The mason reserves the right to review and provide input and acceptance of masonry reinforcing at no additional cost to the mason contractor.
09. No back charges will by accepted by the mason unless he has received advanced,four(4)working days,written notice of any intended back charge and been given
reasonable time to amend any action. Failure of Contractor to submit this notification constitutes a waiver of any right to assert a back charge against the mason.
10. GC superintendent and/or Project Manager have full authority to order extra or changed work in writing.GC shall issue a written change order for any such work no
later than ten days after the written direction by the Superintendent or project manager.
11. Proposal based on the Mason's standard insurance coverage and should an indemnification clause be required,it shall not be broader in breadth and scope than is
required of the G.C.by the owner. Additional named insureds,if required,will only be the G.C.and the owner. Each party's comprehensive general liability insurance
will be considered"primary as to its own interest".
12. Mason shall not be subject to any conditions more stringent than G.C.is bound to the owner by the main contract,general conditions,supplementary conditions to
include but not limited to change orders,schedules,disputes,damages,progress payments,final payment and retention(including interest on retention).
Retainage is to be held to an equal to or less than percentage rate as the General Contractor but not to exceed 5%.
13. This bid is based on quality standards as defined by ASTM C 90-09,ASTM C210-10 and ACI 530.1 where applicable.
14. This bid includes all costs for Mason to comply with all OSHA/W ISHA safety standards.Costs incurred by Mason to comply with General Contractor Safety
requirements in excess of OSHA/W ISHA standards shall be reimbursed by General Contractor upon request by Mason."
