This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Add uniformed Police Officer pay item to increase work zone safety.
Work to be paid to contractor as force account item, with total dollar
amount as "not to exceed".
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.

become effective on the last date written below.

I. Proposed Change
Add Uniformed Police Officer pay item to increase work zone safety. Work to be paid to contractor as Force
Account item, with total dollar amount as "not to exceed".
II. Reason and Background for Change
108th Ave SE is an arterial route and sees steady high traffic volume. The intersection of 108th Ave SE and
SE 264th St receiving the new compact roundabout does not have excess shoulder area to create work zones
that allow for two way traffic during working hours. Additionally, since construction began there have been
frequent incidences of drivers speeding through work zones, not obeying flagger's directions or driving
around traffic control devices into work area or oncoming lanes. To increase safety of pedestrians, workers
and the motoring public, this Change Order would provide for stationing a Uniformed Police Officer at the
construction site when work activities warrant, as determined by the Engineer.

Hi Eric,
Attached is a draft worksheet for adding off-duty police officer presence for construction of the
center island work for review and approval. During the course of perimeter roundabout work,
there have been a number of aggressive drivers who have not obeyed flagger direction. Request
for City of Kent enforcement has been made, but Kent's police department is under staffed and
field crews are unaware of traffic enforcement being made to date during peak traffic hours.
Sean with KBA has reached out to Seattle's Finest, a regional off-duty police officer coordination
company about current rates and charges (attached is a current breakdown of fee structure).
The presence of blue lights and uniformed officers have proven extremely effective in reducing
aggressive driving during sensitive construction work.

This is an official proposal, with the current rates and terms to provide Uniformed Police Officers
(UPO's) for traffic control. Seattle's Finest operates as an employer, with all Officers on our payroll
as employees, and covered by L&I, Employment Security, and a $6,000,000 per occurrence /
$7,000,000 aggregate General Liability Insurance policy.
Rates and Terms:
UPO Flagging and Traffic Control
Our rates are inclusive and cover the Officer's pay and all overhead costs. Our rates are as
follows:
• Base Rate: $99.00 per hour Monday through Friday, 6am-6pm, up to 8 hours.
• Night Differential / Saturday Rate: $111.00 per hour weekdays 6pm-6am, and hours
on Saturday, up to 8 total hours. Anything over 8 hours goes to $153.00 per hour.
• Premium rate: $153.00 per hour all Overtime, Sunday, Holiday, and Last Minute or
Emergency call-out requests (Less than 24-hour notice).
• New Year's Eve and 4"' of July: $168.00 per hour.
• Cancellations require 24-hour notice; otherwise, a 4-hour minimum show-up applies at
that day's standard rate. Officers are entitled to a 30-minute paid lunch if they work 6
hours or more. If not, 30 minutes will be added to their total hours for the shift.

• Intent and Affidavit Filing Fee: $100.00 for each project.

that day's standard rate. Officers are entitled to a 30-minute paid lunch if they work 6

There are 11 holidays that require holiday pay. This is based on the paid holidays recognized by
the largest Law Enforcement Agencies in Washington State. The holidays are:

We bill weekly, and payment is due upon receipt. Payment is expected within 15 business days
or a 1% late fee per month will be applied.
