For valuable consideration and by mutual consent of the parties, the project contract is modified as follows: 1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, Contractor shall provide all labor, materials, and equipment necessary to: Add uniformed Police Officer pay item to increase work zone safety. This Change Order, unless otherwise provided, does not relieve the Contractor from strict compliance with the guarantee and warranty provisions of the original contract, particularly those pertaining to substantial completion date. Reason and Background for Change 108th Ave SE is an arterial route and sees steady high traffic volume. The intersection of 108th Ave SE and SE 264th St receiving the new compact roundabout does not have excess shoulder area to create work zones that allow for two way traffic during working hours. Additionally, since construction began there have been frequent incidences of drivers speeding through work zones, not obeying flagger's directions or driving around traffic control devices into work area or oncoming lanes. To increase safety of pedestrians, workers and the motoring public, this Change Order would provide for stationing a Uniformed Police Officer at the construction site when work activities warrant, as determined by the Engineer. During the course of perimeter roundabout work, there have been a number of aggressive drivers who have not obeyed flagger direction. Request for City of Kent enforcement has been made, but Kent's police department is under staffed and field crews are unaware of traffic enforcement being made to date during peak traffic hours. Sean with KBA has reached out to Seattle's Finest, a regional off-duty police officer coordination company about current rates and charges (attached is a current breakdown of fee structure). The presence of blue lights and uniformed officers have proven extremely effective in reducing aggressive driving during sensitive construction work. Let me know what you think?
