SUMMARY: The Kent Police Department and the Kent School District have partnered for many years to provide school resource officers for various Kent schools, as well as a commander to serve as a liaison and safety advisor to the District. These agreements cover the 2020-2021 and 2021-2022 school years for an initial two-year term, with the option to extend the term of the contract for up to five successive periods of 12 months each. The agreements for the 2020-2021 school year were not executed last year. That contract has been built into the contract for the 2021-2022 school year to ensure the term is memorialized. Given the impacts from the COVID-19 pandemic, the parties agreed that the Department would not charge the District for those services provided by the Department during the 2020-2021 school year, as stated in the agreements. Entering into another contract with the Kent School District will further the Police Department's efforts to remain engaged within the community and assist with the development and education of our youth within the City. The mission of the School Resource Officer program is to help improve and maintain school safety and the educational climate at the school. The purpose of this Agreement is to fulfill the requirements of RCW 28A.320.124(2), which requires an agreement between school districts and the local law enforcement agency for implementation of a School Resource Officer program and specifies elements that must be incorporated into such an agreement. Additionally, this Agreement fulfills the requirements of RCW 10.93.160 and formalizes and clarifies the partnership between the Kent School District and the Police Department. Finally, House Bill 1214, effective July 25, 2021, established training for school resource officers and other requirements that were incorporated into the Agreements. The total reimbursement from the District to the City will be as follows: Packet Pg. 80 8.F The District's reimbursement obligation for the School Resource Officers is $187,894.48, which is approximately 60% of the total cost to the Department for salaries and benefits. The District's reimbursement obligation for the Liaison is $55,186.12, which is approximately 25% of the total cost to the Department for salaries and benefits. The Agreement provided that the parties could agree to extend the term of the Agreement, on the same terms and conditions, for up to five successive periods of 12 months each, provided that: (i) Attachment A to the Agreement was adjusted to reflect the actual salary and benefit cost incurred by the City in providing services under the Agreement, and (ii) each party agreed to the extension in writing. Through their mutual signing of this Extension Letter, the parties agree to the extension of the Agreement for the 2024-2025 school year, beginning on September 1, 2024 and continuing through August 31, 2025, and to an adjustment in the consideration paid by the Kent School District for the services provided by the City of Kent as provided for in Agreement. Except as specifically stated herein, no other modifications to the Agreement shall be made by this "Extension Letter of School Resource Officer Agreement for 2024-2025 School Year." The language in Attachment A to the Agreement is amended to revise the consideration as provided below: ATTACHMENT "A" TO SRO AGREEMENT The parties agree that the total cost to the Department to provide SROs to the District for the 2024-2025 2023-2024 school year, in accordance with the terms of the parties' Agreement, is $363,200.70 regardless of actual salary or benefit adjustments that may be made by the Department for its officers. The District's reimbursement obligation, which is sixty percent (60%) of the total cost to the Department for the SROs provided to the District, equals $217,920.42. Unless overtime is authorized by the District in accordance with Section 8, or the Agreement modified as set forth in Section 9, this sum will be considered the District's total reimbursement obligation for all SROs provided by the Department for the duration of the performance period of this Agreement, regardless of actual salary or benefit adjustments that may be made by the Department for its officers, subject to the Department's obligations to refund the District as set forth in Section 2(1). The District shall pay said reimbursement in twelve (12) approximately equal monthly payments spread over a one-year period starting September 1, 2024 2023 with each payment being made upon submission by the Department of a monthly invoice; provided, in the event this Agreement is executed after the term of this Agreement begins, the District shall pay the total compensation Extension Letter Re: School Resource Officer Agreement Page 1 of 2 (between City of Kent and the Kent School District) as set forth in this Attachment, but will have fewer months to make such payments. The amounts provided for in this Attachment "A" shall be adjusted annually for each 12-month Renewal Term and shall be based upon the actual salary and benefit cost to the Department for the SROs. Each adjustment shall be memorialized through an amendment to this Attachment "A," which shall become an addendum to this Agreement upon acceptance by the District and the Department. As per Law 28A. 320.1242 (1)(a) If a law enforcement agency or security guard company supplies safety and security staff to work on school property when students are expected to be present,the school district must annually review and adopt an agreement with the law enforcement agency or security guard company that meets the requirements of this section. By agreeing to these extensions,the Kent School District endeavors to continue partnerships with our local law enforcement agency to provide: • One (1) Kent Police Commander in the form of a School Safety Services Liaison.The Kent School District shares the total cost of the commander with the Kent Police Department.The total cost of the Liaison for the 2024-2025 school year is$277,380.The Kent School District is responsible for 25%of the total cost which equals$69,345. • Two (2) Kent Police School Resource Officers.The primary areas of service are Kent-Meridian High School, Mill Creek Middle School, Canyon Ridge Middle School, iGrad, Kentridge High School, Meridian Middle School,and Kent Laboratory Academy.The Kent School District shares the total cost of the School Resource Officers with the Kent Police Department.The total cost of the School Resource Officers for the 2024-2025 school year is$363,200.70.The Kent School District is responsible for 60%of the total cost which equals$217,920.42. BOARD GOALS: Goal 3: Building equitable systems and school environments BUDGET IMPLICATION: For the 2024-2025 school year, the cost to the Kent School District for one (1)School Safety Liaison is $69,345 paid out of the 2024-2025 Safety Services Budget.This is an increase of$5,005.50 from the 2024-2025 school year due to annual salary increases. For the 2024-2025 school year,the cost to the Kent School District for two (2)School Resource Officers is$217,920.42 paid out of the 2024-2025 Safety Services Budget.This is an increase of$12,178.85 from the 2023-2024 school year due to annual salary increases. For the 2024-2025 school year, the total cost to the Kent School District for both extensions are $287,265.07 paid out of the 2024-2025 Safety Services Budget.This is an overall increase of$17,184.35 from the 2023-2024 school year. RECOMMENDATION: That the board of directors approves this item.
