SUBJECT: INFO ONLY: Kent Laboratory Academy - School's Out Park
Program
SUMMARY: Brian Levenhagen, Deputy Director, Parks, Recreation & Community
Services will provide information to the Council regarding the Kent Laboratory
Academy - School's Out Park Program. This partnership between Kent Parks and
the Kent School District will open up school grounds at Kent Laboratory Academy to
the public when school is not in session in an area of Kent shown to be underserved
in the 2022 Park and Open Space Plan.

Addendum 3 to Agreement Between Kent School District No. 415 and City
of Kent Parks & Recreation Department City of Kent
This Addendum is entered into on , by and between the Kent
School District No. 415 (hereafter referred to as the "District"), and the City of
Kent, Washington (hereafter referred to as the "City") and is designated Addendum
3 to the Agreement between Kent School District No. 415 and City of Kent Parks &
Recreation Department City of Kent.
RECITALS
A. Whereas both parties recognize the shared commitment to enhancing the
educational experience and overall well-being of the students and families
within the Kent community;
B. Whereas, by partnering together, the District and the City can leverage
resources, expertise, and networks to provide comprehensive services that
address the diverse needs of Kent students and families;
C. Whereas government-to-government collaboration underscores the
commitment to effective governance and stewardship, ensuring that
taxpayer resources are maximized for the benefit of the community as a
whole;
D. Whereas the partnership between the District and the City exemplifies
proactive governance and responsive leadership, setting a precedent for
effective intergovernmental collaboration and cooperation;
E. Whereas the City has a critical need to expand access to parks and green
space in the Panther Lake area for its residents who are currently
underserved within the City's park system;
F. Whereas the City and the District entered into a Joint Use Agreement dated
April 5, 1983, still utilized today, regarding the adequate programming of
community recreation under the auspices of Kent Parks and Recreation;
G. Whereas the District recently built a new school facility, the Kent Laboratory
Academy, with outdoor play areas, courts, and other parklike amenities, in
an area identified as 'underserved' by the City when it comes to the provision
of public parks and recreation provisions;
H. Whereas, the City and the District wish to add to and modify the provisions
of said Agreement for an operating agreement to open designated portions of
the grounds at Kent Laboratory Academy for general public use during
agreed-upon hours, to allow the community to use this space as their local
park;
I. Attached hereto as Exhibit 1 and incorporated by reference, is a map which
generally illustrates the portion of the Kent Laboratory Academy Grounds to
be opened and accessible to the public and operated by the City of Kent's
Parks, Recreation and Community Services Department.
AGREEMENT
SECTION 1: Purpose and Subject Matter
The purpose of this addendum is to set forth the terms and conditions that will
open the Kent Laboratory Academy ("KLA") grounds ("Park Space"), identified in
Exhibit 1, for public use outside of school hours, under the terms specified below, to
increase the park and recreation level of service in this area of the City.
SECTION 2: Park Operating Hours
On days that school classes are in session, the City shall be allowed to open the
Park Space for public use during the hours of 4:00 PM to dusk. On all other days,
the City shall be allowed to open the Park Space from dawn to dusk. Other' days
may include summer months when school is not in session, pre-established school
holidays or breaks, weekends throughout the year, etc.
SECTION 3: Operations, Maintenance and Repair
A. The City agrees to lock and unlock KLA gates to the Park Space and/or
parking lot, as needed, to operate the grounds unless District staff are
assigned to do so as part of normal District practice. The District will notify
the City at least 2 weeks in advance if the City needs to take over
responsibility for locking or unlocking gates if District staff is no longer
available to lock or unlock gates changes. If the District or the City has a
need to change keys, they will immediately inform the other and provide
updated keys.
B. The City agrees to pick up litter daily when the KLA grounds are open to the
public, as defined in Section 2.
C. A City managed garbage can will be installed at a mutually agreed location
and the City will empty the garbage can on site, when necessary.
D. The City will pay all fees associated with garbage removal of the Park Space
during identified public open hours, as defined in Section 2.
E. The City will be responsible for park rules enforcement during park operating
hours.
F. The District is responsible for grounds maintenance of the site, including
playground safety inspections, court maintenance, turf maintenance, utility
payments, and any other tasks they already do.
SECTION 4: Signage
A. The District authorizes Kent Parks to install a branded sign at main access
points to the grounds and a sign at the corner of 108 Ave SE and SE 208t"
ST. These signs will specify when the Park Space is open to the public.
B. The District authorizes Kent Parks to add a park rules and hours sign at the
gate to the Park Space, with park rules aligning with the rest of Kent Parks
system and in effect during public open hours, identified in Section 2.
C. The City will work with the District to install a sign communicating the nature
of the agreement between the District and the City for use of the site. This
sign will be approved by District staff, prior to being installed.
D. The City will pay to install and maintain any signage that is installed as part
of this agreement.
SECTION 5: Communication and Collaboration
A. City and the District representatives will meet regularly to discuss joint
operating concerns, or other collaboration that would benefit both
organizations and generally communicate to maintain open and
transparent communications. The City will add this KLA Park Space on its
website, under its Park Directory, which will also clarify operating/open
hours along with communication of the collaborative partnership between
the City and the District.
B. The City and the District will work together, when appropriate, on joint
marketing or other promotional efforts for this Park Space, where
applicable.
SECTION 6: Duration of Amendment
A. The first year of the agreement is a test period for both parties to confirm the
viability of joint use of the space. The term of the one-year test period is
from the date of the latest signature on this addendum.
B. This Agreement shall continue indefinitely until canceled by either party.
After the first year, either party may cancel this Agreement with 60 days'
notice in writing.
SECTION 7: Effect on Joint Use Agreement
Except as may be amended by this Addendum, all other terms and conditions of the
Agreement between the District and the City shall remain in full force and effect. In
the event of a conflict between this addendum and the Joint Use Agreement, this
Addendum shall control, including provisions concerning days and times of Park
Space use.
IN WITNESS WHEREOF the parties hereto have caused this Agreement to be
executed on their behalf.
