Declaration of Restrictive Covenants
City of Kent, a municipal corporation of the State of Washington ("Declarant"), is the
owner of real property located in the City of Kent, King County, State of Washington, known as
King County Tax Parcel Number 102204-9021 (the "Property"), more particularly described in
Exhibit A, attached hereto and by this reference incorporated herein.
'The purpose of this instrument is to document that the portion of the Property labeled
"10,000 SF Compensatory CFT Land" and depicted on Exhibit I3, attached hereto and by this
reference incorporated herein, shall be restricted to uses in accordance with Conservation Futures
Tax Levy funding.
King County recently transferred fee simple ownership of the Property to the Declarant
pursuant to a Quit Claim Deed, fully executed June 15, 2023, and recorded with the King County's
Recorder's Office, Recording Number 20230616000 7. 'This action is being taken to provide
replacement land to satisfy Conservation Futures conversion requirements associated with removal
of Conservation Futures covenants from portions of Declarant's King County Tax Parcel Number
112204-9064 (which are depicted as "Playground Area Impacts," "Playground Area Swings
Impacts," and"Pickleball Court Impact Areas" on Exhibit B).
Therefore, the portion of the Property labeled as "10,000 SF Compensatory CFT Land"
on Exhibit B is hereby subject to the following restrictive covenants:
The property herein conveyed was purchased with King County Conservation Futures Tax
Levy funds and is subject to open space use restrictions and restrictions on alienation as
specified in RCW § 4.34.200, et seq., and King County Code §26.12.005, et seq.
