The parties agree that upon the execution of this Memorandum of Understanding (MOU), the Police Fitness Center may be used by any employee of the Kent Police Department, subject to any applicable provisions of the Police Department and any related Standard Operating Procedures of the Kent Police Department. To the extent Police Department operations and staff coverage may allow, Correction Officers and Correction Sergeants of the Police Department, may be allowed time on-duty each workday for physical exercise in the City-provided exercise facility at the Police Department, under the following conditions: 1. Exercise time will not be allowed during the last three hours of an employee's shift if the employee has daily paperwork to complete, or if the employee has other tasks that need to be completed prior to the end of their shift. 2. Exercise time will not be allowed without prior advance management approval. This includes both the time sought by the employee to exercise and the duration of the employee's requested exercise time. 3. Employees are required to complete an orientation with Peer Fitness personnel identified by management prior to using the facility. 4. Employees must wear appropriate exercise attire at all times. S. Longer exercise periods and shower time may be permitted with prior approval from management. 6. An employee's failure to receive exercise time shall not result in any overtime liability for the City. Additionally, an employee's failure to obtain prior advance management approval to exercise on duty, which results in their later request being denied, shall not be grieved under the CBA. 7. The ability to exercise on duty is provided at the Chief's discretion. The parties agree the Chief may end this program at any time, and in such an event, any time spent exercising will no longer be compensable or otherwise permitted. 8. Employees are required to report to their supervisor all injuries incurred while using the exercise facility. This MOA was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOA, it shall be interpreted evenly, and not for or against either party as "the drafter". of the MOA. By signing below, the parties agree that the above represents the parties' full and entire agreement with respect to the subject matter of this MOU. This MOU shall not be interpreted to create a past practice, nor does it waive the other party's right to bargain over wages, hours, and working conditions as provided by law. This MOU shall be deemed executed and agreed to upon the signature of the parties below.
