I. RECITALS 1.1 Through the efforts of their separate agencies, the City and Holy Spirit reach out to the homeless and low-income residents in the Kent community throughout the year. This segment of Kent's community has a substantial need for shelter when severe weather conditions strike during the winter months. 1.2 The City and Holy Spirit have expressed their mutual desire to partner with one another to provide severe weather shelter when outside temperatures reach 32 degrees Fahrenheit for 24 or more consecutive hours, when snow has or is expected to exceed three inches in depth, or when other conditions are severe enough to present a substantial threat to life or health of persons. 1.3 The purpose of this MOU is to outline each party's understanding and expectations regarding this collaborative effort. II. MOU NOW THEREFORE, in consideration of the terms and provisions contained in this MOU, the City and Holy Spirit agree as follows: 2.1 Purpose. The purpose of this MOU is to establish a collaborative effort between the parties to operate a limited shelter at the Holy Spirit during extreme weather conditions that may occur from approximately November 1 through March 31 of each year. 2.2 Roles and Responsibilities. The following outlines the intended responsibilities of each party to this MOU: A. The City will perform the following duties: (1) From November 1 through March 31, the City will monitor winter weather conditions and, should the City determine that it is advisable that the MEMORANDUM OF UNDERSTANDING FOR EMERGENCY SEVERE WEATHER SHELTER - 1 (btwn. City of Kent and Holy Spirit Parish) severe weather shelter be opened, it will use its best efforts to call Holy Spirit at least twelve (12) hours before the shelter should be open to accept clients. (2) The City will declare that a severe weather condition exists, and will request that Holy Spirit open a severe weather shelter, when low outside temperatures are at or below 32 degrees fahrenheit for 24 or more consecutive hours, when snow accumulations exceed or are expected to exceed 3 inches, or when other conditions exist that are deemed by the City to be severe enough to present a substantial threat to life or health of persons. (3) The City will contract with a provider to provide trained staff to conduct safety screening of those clients seeking shelter at Holy Spirit and to monitor and supervise shelter clients throughout their over-night stay in the shelter. (4) The City shall indemnify Holy Spirit for damage that occurs during the operation of the Severe Weather Shelter attributable to the negligence of the City or its agents. B. Holy Spirit will perform the following duties: (1) From November 1 through March 31, when the City declares that a severe weather condition exists that necessitates the opening of a severe weather shelter, the City will ask Holy Spirit to open a shelter to house up to 50 individuals while the severe weather condition exists. Men will be housed together in one room, women will be housed together in another room, and families will be housed together in a third room. The City understands that there may be circumstances when Holy Spirit cannot open its facilities due to loss of power, lack of volunteers, etc. (3) Holy Spirit will operate the severe weather shelter according to the following genera/ schedule: • Church staff and volunteers will arrive by 8:00 PM to prepare the space • Urban League staff expect to arrive at 8:30 PM • 9 PM - The shelter opens to receive clients • 7:00 AM (or 8:00 a.m. pending staff availability). Shelter closes. ** Holy Spirit's preference is to remain open until 8 a.m. given the possibility of very low temperatures and darkness/low visibility The shelter may be opened earlier or remain open later if both the City and Holy Spirit agree. During these times, staffing will be managed by Holy Spirit volunteers. (4) Provider will prepare facility for opening, and work with volunteers to prepare table for light refreshments. City of Kent and Holy Spirit Parish) (5) Holy Spirit will accept residents who are referred to Holy Spirit by service providers, emergency services, faith groups, walk-ins, or other referrals.
