In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order,
including, without limitation, claims related to contract time, contract acceleration, onsite or
home office overhead, or lost profits. This Change Order, unless otherwise provided, does not
relieve the Contractor from strict compliance with the guarantee and warranty provisions of the
original contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change
Order shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this
contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this
project to be consistent with the revised contract sum shown in section 2, above.

II. Reason and Background for Change
Additional pavement repairs are needed on S 277th St in preparation for the upcoming chip sealing
project (anticipated for Spring/Summer 2024). Public Works managmeent determined a change order for
this project would be the best way of addressing the roadway repairs. Pricing as referenced in Icon
Materials' "Kent Added Work 277th.pdf" COP.

After talking with Matt at Icon, we updated the COP by adding planing and we discussed and
agreed on TC estimates. Based on what we saw this summer, I anticipate we won't be doing
much (if any) full depth repair, and most of this is top down milling to get into good asphalt
base.
The updated total I am seeking approval for is #31,026.00

Attached is Icon's proposal for the dig out areas. Their quantities are based on full depth
subgrade repairs. I spoke with them regarding traffic control and they anticipate 2 days of work
with 1 TCS and 4 TCL. I calculated flagging totals based on 9 hour days to build in contingency;
if we proceed with a change order, I will add the reflected quantities and pay on what is actually
used.
I am seeking approval to create a change order worksheet for $28,678 for the purpose of
performing the pavement repairs on S 277th as laid out by Bill/Brent in the field.

Attached is draft plan sheets with 3 areas on S 277th that need to be repaired prior to next
year's (2024) chip seal project. 2 areas were previously identified for repair, plus a V has been
identified and marked on these plan sheets.
Assuming unit prices from the 2023 Overlay project plus added lump sum values for Mobilization
and Traffic Control Devices, I estimate the cost to the contract for completing the repair of these
3 areas could be roughly $92,000.
With your concurrence, we will proceed with scoping out the work with the contractor and our
stakeholders. Hard pricing will be established and memorialized via a change order on the 2023
Overlay project prior to proceeding with the work.

Subject: 277th dig outs- 2024 chip seal vs pavement preservation
Hi Kelly,
After our chi seal budget meeting yesterday Derek and I spoke with Joe regarding the dig out
work which needs to be completed ahead of chip seal on 277th St. Joe indicated that this work is
not optimal to be completed by in house staff because of the scale of traffic control required.
However, we all agreed that this work would be better bundled with the Chip seal project
because then the chip seal contractor is in charge of the schedule and not waiting on another
project to finish. Joe added this is common on WSDOT chip seal projects which he looked up.
Can we proceed to hand off the dig outs to Joe/Ryan to add to their chip seal project?
