This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Price increase to provide and install 4 each Catch Basin, type 2 96"
structures in place of Bid Item 4095 Catch Basin, Type 2 72" (SDMH #1,
2, 3, and 4.)
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

I. Proposed Change
Price increase to provide and install 4 EA Catch Basin, Type 2 96" structures in place of 4 EA Bid Item
4095 Catch Basin, Type 2 72" (SDMH #'s 1, 2, 3, & 4).
II. Reason and Background for Change
During the submittal review process, it was bought to the City's attentention that the 72" storm
manholes called out on the plans will not work for this application. The size of the 48" knockout in the
manhole structure resulted in less then 12" of concrete between the holes. It was agreed upon to upsize
the manholes to 96". Rodarte provided up front pricing for the cost increase. This change was approved
and the manholes were ordered on 10/26/2023.

We received the attached pricing from Rodarte for upsizing four storm drain manholes on our
WA Ave Pump Station project. Three structures will be upsized from 72" to 96" (SDMH's 2, 3, &
4) and one will be upsized from 72" to 84" (SDMH 1). Rodarte is seeking compensation for the
premium to purchase the larger manholes, the mobilization cost of a larger excavator to handle
the larger structures, and the premium cost for the larger excavator that will be used to install
the manholes and the associated 248 LF of 48" storm pipe.
The contract bid item price for the 4 each 72" SDMH's is $64,000 ($16,000/ea). Rodarte is
requesting a premium cost of $47,893.52 total (or $11,973.38/ea) as an add to the bid item
price.

Are you okay with moving forward with production of these larger structures and preparing a
change order in the amount of $47,893.52 for the upsize of these 4 storm drain manholes?

Took me a minute to understand what is going on.
They're only upsizing MH 1 to 84" and MH's 2-4 to 96", explaining the difference in cost on that
structure. Was thinking the equipment time was high for just setting the structures, but they will
use the bigger excavator to lay the pipe once it's out there, so that adds up.
So if I understand correctly, we'll pay the BI 4095, CB Type 2 72 inch Diameter, $16,000, 4 EA;
plus the $47,893.52 extra (CO). Is that how everyone understands it? I don't think we can argue
too much based on the back up.
