ORIGINAL AGREEMENT DATE: 6/9/2022
This Amendment is made between the City and the above-referenced Consultant or Vendor
and amends the original Agreement and all prior Amendments. All other provisions of the original
Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force
and effect. For valuable consideration and by mutual consent of the parties, Consultant or
Vendor's work is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, the Consultant or Vendor shall:

shall provide revised design and permitting work.
2. The contract amount and time for performance provisions of Section II "Time of

The Consultant or Vendor accepts all requirements of this Amendment by signing below, by
its signature waives any protest or claim it may have regarding this Amendment, and
acknowledges and accepts that this Amendment constitutes full payment and final settlement of
all claims of any kind or nature arising from or connected with any work either covered or affected
by this Amendment, including, without limitation, claims related to contract time, contract
acceleration, onsite or home office overhead, or lost profits. This Amendment, unless otherwise
provided, does not relieve the Consultant or Vendor from strict compliance with the guarantee and
warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if any), and
this Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed,
and the terms of the Agreement, previous Amendments (if any), and this Amendment shall be
deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this Amendment, which is binding on the parties of this contract.

Proposal for Landscape Architectural Services-Springwood Park Additional Services Request
Dear Kerry and Brian:
This additional services request for Springwood Park is for revised design and permitting work requested
over the course of the project including:
- Requested playground area design revisions to after the previously approved concept, including
general design layout changes and revising the surfacing to be all engineered wood fiber in lieu of
a combination of poured in place and engineered wood surface. (revised detailed scope and
revised fee provided below)
- Addition of a requested water spray feature and the associated utilities and drainage design
(revised detailed scope and revised fee provided below)
- Revisions to the project design in order to address permit related comments, including
modifications to the nature play trail design. (revised detailed scope and revised fee provided
below)
This is an amendment to our proposal dated February 5, 2022.
Task 1: Playground Design Revisions
We will provide the following services for this task:
a. Redesign of play area to eliminate PIP surfacing, associated grading changes, removal of
trees from the play area, and addition of cast in place concrete access ramps.
b. Project management, administration, and coordination in support of the work.
Task 2: Water Spray Feature Addition
We will provide the following services for this task:
a. Coordinate selection and placement of a water spray feature within the park (fee amount
reduced based on city comments)
b. Line sizing, valves&appurtenances, drainage design, and cost estimating pertaining to the
water spray feature (water service line component removed from fee amount based on city
comments)
c. Support of the city in coordination with Lake Meridian Water for water calculations pertaining to
the water spray feature. (fee amount reduced based on city comments)

d. Project management, administration, and coordination in support of the work
Task 3: Permitting Related Design Revisions—Remove Nature Play
We will provide the following services for this task:
a. Redesign of the nature play trail and associated features to relocate program outside of the
wetland buffer area, or removal of these features from the park design documentation. (fee
amount based on city comments).
b. Revisions to the Critical Areas Report pertaining to the design revisions to remove the nature
play trail from the project. Coordination and collaboration with the city permitting group to best
understand the nuance of their code,which have taken extra coordination above and beyond
the initially scoped effort for permitting and environmental documentation. (fee amount
reduced based on city comments)
c. Project management, administration, and coordination in support of the work
