All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows: 1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, the Consultant or Vendor shall: Amendment #1 for master planning and development design for East Hill North Community Park (Huse Property). Additionally,this proposal includes services like Bidding and Construction,full geotechnical report and boardwalk design through a wetland which were not included in our current contract. In total,this additional services request is$199,500. This request is composed of the following elements: New Scope Related Items for SD through CD Increased Maximum Allowable Construction Costs(MACC) The original proposal was based on an assumed MACC of$3,500,000. Recent conversations with Terry suggest the MACC will increase beyond $4,155,110 and likely include addition of bid alternates (or additives). An increased MACC generally leads to additional program, complexity of program, detailing, process, permitting etc. Design and Documentation Scope Additions - Structural consultation, hourly NTE: Wood framed trellis structure with conventional spread foundations, light pole foundations, shed modifications (ref below for boardwalk) - Restroom structure including architectural guidance and coordination of prefabricated structure - Water service design, documentation and permitting from 132nd Ave SE. - Boardwalk design including structural engineering, geotechnical engineers (see below), etc. The addition of a boardwalk connection through the western wetland and power easements infers pedestrian trail connection to 132nd.This additional scope only includes design to the right of way. Actual sidewalk/streetscape/ ROW design is excluded and will be contracted separately once a decision has been made with the City. It is assumed that the provider(GreenFlush)will provide the required engineering for permitting and operations. We have allocated a small fee for coordination between civil, architecture and the restroom manufacturer/engineer. Recommend this portion of fee be contracted hourly, not-to-exceed. Geotechnical Engineering Services/Report The preliminary geotech report provided basic guidance via hand borings at various locations on the site.This report offered basic recommendations for foundations, construction considerations and infiltration feasibility. For design and permitting, additional infiltration testing is required for stormwater management. The boardwalk also requires new borings and design recommendations. Permitting, Natural Resources, etc Several elements proposed in the master plan are either in a wetland or within wetland buffers. These features must be documented and accounted for via mitigation sequencing.This is a new scope element excluded from the original contract. Sustainable SITES The original contract did not include scope and fee for documentation of the Sustainable SITES certification.This process requires extensive coordination with the owner's planning and operations team, additional information gathering, graphic production and documentation. Bidding and Contracting The original contract did not include scope and fee for bidding and construction tasks.This amendment includes fee associated with Bidding and Contracting, but does not include Construction Administration services, which will be contracted at a later date. While some of these additions were anticipated (geotech, permitting support, etc) we do not take these requests lightly. Please call if you have any questions or comments regarding this proposal.
