In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

I. Proposed Change
This change order provides complete payment for:
Crosswalk widening 1 LS $18,908.96
Adding Black DWS at Pass Throughs 1 LS $6,397.44
II. Reason and Background for Change
Designed crosswalk markings were not wide enough to span the entire throat of multiple curbramps
throughout this project. WSDOT noted this on their final walk through and is requiring the markings to
be widened to span the entire throat of the ramps. This change order pays for the scarifcation of the
existing and reapplication of the crosswalk markings to the correct width. This change order also covers
the costs of adding black surface applied detectable warning surfacing (DWS) to the wide gutterpan
adjacent to the yellow DWS at the median passthrough ADA ramps to provide warning to users that
they are about to enter the roadway. This was also required by WSDOT following their final walk

Jason,
I am seeking authorization to proceed with creating a change order in the
amount of $25,306.40 to remediate the ADA comments from WSDOT. This will
be the final WSDOT item on the 4th & Willis roundabout, leaving only extended
landscaping as remaining contract work.
This change order will be payment for the added black surface applied DWS at
the pass through islands (4x islands x 4x sections = 16 ea) that WSDOT has
permitted as a fix for the DWS not covering the gutter pan. WSDOT asserted
that since the gutter pan is wider than typical, it could be mistaken for
pedestrian access to a visually impaired person.
Additionally, this change order would compensate SPM for re-marking the
crosswalks where the marks were put in per plan, but did not span the entire
width of the DWS at almost all of the curb ramps. SPM would scuff the existing
markings and re-stripe the entire cross walk areas. This will not only create a
compliant channelization, but extend the life of the existing markings by several
years.

to be done.

I circled back with Specialized Pavement Markings for pricing on the crosswalk striping.Jason with
SPM said you were going to consult with your road department if they wanted to refresh (R&R) all
crosswalk bars for quality and longevity reasons to the preferred length or if SPM were to just
patching/adding to the crosswalk bars to meet the length.Jason with SPM mentioned that
patching/adding would look terrible with existing bars showing signs of wear and that SPM could not
use the torch down method with a flammable material butting up to it.
