Public Recognition i. Employee of the Month Mayor Ralph announced Tammy Fowler as the City of Kent's Employee of the Month. ii. Proclamation for Fetal Alcohol Spectrum Disorders Awareness Month Mayor Ralph presented the Proclamation for Fetal Alcohol Spectrum Disorders Awareness Month to Alex and Clara O'Keeffe. Alex and Clara O'Keeffe spoke and thanked the Council for their support for Kent City Council City Council Regular Meeting September 5, 2023 Minutes Kent, Washington raising awareness for Fetal Alcohol Spectrum Disorders. iii. Proclamation for Childhood Cancer Awareness Month Mayor Ralph presented the Proclamation for Childhood Cancer Awareness Month to Emily Stenson and Family. The Stenson family expressed appreciation of the Proclamation. B. Community Events Council President Boyce announced upcoming events at the accesso ShoWare Center. Councilmember Fincher announced the TeamUpToCleanUp event on September 30t". Visit Kentwa.gov/talkingtrash to sign up. Fincher invited the public to attend the art exhibit in the City's Centennial Center. S. REPORTS FROM COUNCIL AND STAFF A. Mayor Ralph's Report Mayor Ralph attended an event at the Museum of Flight and indicated two of the filmmakers working on a project about the legacy of space in Washington State and the future are graduates of Kentridge High School. B. Chief Administrative Officer's Report Chief Administrative Officer, Pat Fitzpatrick advised staff continues to work on preparing the budget. Additionally, Fitzpatrick and Mayor Ralph are working with the City's Lobbyist on the City's legislative agenda. Fitzpatrick advised the Executive Leadership Team is participating in LEAN trainings. C. Councilmembers' Reports Council President Boyce serves as the chair of the Committee of the Whole and provided a recap of the Operation's items on today's agenda. Council President Boyce serves as the chair of the Council Workshop and provided a recap of the two presentations from tonight's meeting. Councilmember Michaud serves as the Subject Matter Chair for the Parks and Human Services agenda items on today's Committee of the Whole and provided a recap. Councilmember Troutner serves as the Subject Matter Chair for the Economic and Community Development items on today's Committee of the Whole agenda and provided a recap. Councilmember Thomas serves on the Puget Sound Regional Fire Authority that will meet September 6th at 5:30 at station 78. Councilmember Fincher serves as the Subject Matter Chair for the Public Works items on today's Committee of the Whole agenda and provided a recap. 6. PUBLIC HEARING A. Public Hearing on the Resolution Relating to Linda Heights Park— Washington State Recreation and Conservation Office Deed of Right Release - Adopt Mayor Ralph provided an overview of the public hearing process and opened the public hearing on the Resolution Relating to Linda Heights Park- Washington State Recreation and Conservation Office Deed of Right Release. Parks, Planning and Development Manager, Terry Jungman provided an overview of the project that included the project background. The pump station is past it's useful live and needs replacement and the current location inside the park is not ideal for maintenance and access and park users. The Linda Heights Pump Station Replacement Project will place a new pump station on land that was purchased with assistance from the Washington State Recreation and Conservation Office ("RCO"). The deed from RCO requires that the property be maintained for outdoor recreation and park purposes. The City has requested release of this requirement in order construct the new pump station. The current pump station is adjacent to the property where the new pump station will be built. The property underlying the existing pump station is no longer needed for public utility use and will be reincorporated into Linda Heights Park. Resolution No. 2039 previously authorized the Mayor to sign the relevant property documents. However, this resolution is required to comply with RCW 35A.21.410 and RCW 35.94.040 by authorizing the removal of restrictive covenants and declaring the property surplus to utility needs. Additionally, siting the new pump station on this property required the City to find replacement property of equal value to use as replacement property. The City recently purchased the Mendel Property at Mill Creek Canyon that is being used as a replacement. After a lengthy process, RCO approved the deed of release for the pump station property and the replacement property at Mill Creek Canyon Park. Boyce moved to close the public hearing, seconded by Thomas. The motion passed unanimously with a vote of 7-0. There was no Council discussion or debate. No persons were signed up to provide public comment. No written public comments were received. MOTION: I move to adopt Resolution No. 2063, to authorize the removal of restrictive covenants from and declare surplus to utility needs portions of Linda Heights Park. PUBLIC COMMENT Don Dinsmore, a Kent resident, provided public comment by expressing appreciation for the work of the Council to improve South 2561" Street in the area of 132nd Avenue S.E. Darryl Jones, a Kent Resident, provided public comment regarding suggestions to make Kent more inviting. 8. Federal Way Link Extension Staffing Agreement - Authorize MOTION: I move to authorize the Mayor to sign the Amendment to Task Order 2 of the City Services Agreement between the City of Kent and Sound Transit for additional funding of $1,750,000, subject to final terms and conditions acceptable to the Chief Administrative Officer and City Attorney. D. Washington State Recreation and Conservation Office Local Parks Maintenance Grant - Resolution Authorizing - Adopt MOTION: I move to adopt Resolution No. 2064, authorizing the signing and submittal of grant application #23-1552M to the Recreation and Conservation Office, to assist with the Lake Meridian Playground Surfacing Replacement. 9. OTHER BUSINESS None. 10. BIDS A. 84th Avenue South (East Valley Highway) Preservation - South 212th Street to South 196th Street - Award Public Works Director, Chad Bieren provided an overview of the project and recommended awarding to ICON. MOTION: I move to award the 84t" Avenue South (East Valley Highway) Preservation - South 212t" Street to South 196t" Street Project to ICON Materials in the amount of $2,260,556 and authorize the Mayor to sign all necessary documents, subject to final terms and conditions acceptable to the City Attorney and Public Works Director.
