Re: Request for Waiver of City's Bidding Requirement and ratification for Belfor's
services for the City's Riverbend Golf Complex Driving Range electrical fire
The City's Parks, Recreation, and Community Services (PRCS) Department requests an exception
to the competitive bidding requirement under KCC 3.70.080(C) and KCC 3.70.110 for the City's
use of Belfor's services related to the City's Riverbend Golf Complex Driving Range electrical fire
that occurred on July 25, 2022, as well as ratification of the acceptance and payment of the
invoices for these services. Under section 3.70.080(C) for purchases where the estimated cost
is greater than thirty-five thousand dollars ($35,000), but sixty-five thousand dollars ($65,000)
or less, the director shall attempt to solicit and document at least three (3) written bids or quotes
for the purchase. Under Section 3.70.230(A), all purchases or work valued at an amount in
excess of $20,000 must be memorialized in a written contract and signed by the mayor.
However, under the circumstances explained below, PRCS was unable to obtain three (3) written
bids and execute a contract prior to having services rendered from Belfor.
On July 25, 2022, the Riverbend Golf Complex Driving Range located at 2020 West Meeker
Street, Kent, Washington had an electrical fire due to a short in the Puget Sound Energy (PSE)
line that feeds the building. The fire department responded, and the use of a fire extinguisher
and water was necessary to ensure the fire was put out properly. The City required immediate
remediation services, and Belfor provided initial clean up, as well as restoration and smoke
removal services. The total cost for services was $58,354.49, including tax.
KCC 3.70.110(A) allows the mayor to waive bidding requirements for the purchase of services
upon a finding that the bidding requirements would otherwise not be practicable or in the City's
best interests under the circumstances.
For these reasons, I respectfully request that you waive the competitive bidding requirements
for this service and ratify the acceptance of the written invoices by signing below. Thank you for

The attached estimate details the specific work to be completed. Additional work outside of that specified in this estimate will
be through separate proposal(s)and/or change order(s)detailing the additional/changed scope of work as well as the terms and
pricing of those changes. Repairs will be scheduled after a signed copy of this estimate is received.
Progress payments may be billed at 25%,50%,75%,and 90%of completion with the balance due upon substantial completion
of this scope of work. Change orders will be billed as completed and credits will be applied to the final contract billing.
Unless noted otherwise,the customer is required to provide heat,water and electricity on-site for the duration of this project.The
customer is responsible for providing continuous access to the project area during normal business hours,Monday-Friday, 8:00
am-5:00 pm. Where an item is being replaced,we will be matching the existing item's quality,color,finish,texture or material
as close as possible where applicable unless noted otherwise,there is no guaranty either specified or implied on exact matches.

following estimate is$20,448.88.
The attached estimate details the specific work to be completed. Additional work outside of that specified in this estimate will
be through separate proposal(s)and/or change order(s)detailing the additional/changed scope of work as well as the terms and
pricing of those changes. Repairs will be scheduled after a signed copy of this estimate is received.
Progress payments may be billed at 25%,50%,75%,and 90%of completion with the balance due upon substantial completion
of this scope of work. Change orders will be billed as completed and credits will be applied to the final contract billing.
Unless noted otherwise,the customer is required to provide heat,water and electricity on-site for the duration of this project.The
customer is responsible for providing continuous access to the project area during normal business hours,Monday-Friday, 8:00
am-5:00 pm. Where an item is being replaced,we will be matching the existing item's quality,color,finish,texture or material
as close as possible where applicable unless noted otherwise,there is no guaranty either specified or implied on exact matches.
This estimate does not include hazardous material testing or abatement unless specifically detailed in the following estimate.
