This Change Order amends the 'above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Delete bid item 4085 on State Avenue and bid item 8180 on James
Street (two type 2, 48 diameter catch basins). Delete bid item 8160
(connect new catch basin, type 2, to existing 24" storm drain reinforced
concrete pipe). Add new force account pay item for the connection of
the new 16" ductile iron pipe to the existing 24" reinforced concrete pipe
(connect new 16" DI pipe to existing 24" reinforced concrete pipe).
Replace bid item 8150 ductile iron storm sewer pipe, 14" diameter class
50 with ductile iron storm sewer pipe, 16" diameter class 50.
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

I. Proposed Change

II. Reason and Background for Change
Upon further investigation it was discovered that the exisitng Type 2 Catch Basins on James St and State Ave were not
the same dimentions of the new proposed Type 2 Catch Basins. This left an elevation bust of 5"-8" at final rim grade
above the exisiting surface elevation. The elevation issue on State Ave can be resolved by installing a Type 1L Catch
Basin which was approved by the City's Storm Department. The elevation issue on James St is being solved by directly
connecting the new 16" Ductile Iron Pipe to the exisitng 24" Reinforced Concrete Pipe and pouring a concrete collar
around the connection to ensure a water tight seal. The replacement of the 14 Ductile Iron Storm Sewer pipe to the
16" Ductile Iron Storm Sewer Pipe is due to lead times on the 14' pipe. The supplier could not have the pipe delivered
in the time frame needed to complete this portion of the project.

I'm thinking we technically need to do a Change Order.
Here's my thoughts:
DELETE BI's 4085 & 8180 Catch Basin, Type 2, 48" Diameter;
ADD CO 1 Type 1L, 1 EA;
REPLACE BI 8150 Ductile Iron Storm Sewer Pipe, 14" Diameter Class 50 with CO 1
Ductile Iron Storm Sewer Pipe, 16" Diameter Class 50 (I'd guess since 14" is special
order, material costs are likely as much or more with the 14" as the larger 16"). See what
Ben thinks.
We'll also have to compensate Scarsella for some T&M to connect the new 16" pipe to the
existing 24" on James. I'd recommend doing that on FA and paying under BI 8360 Minor
Changes.

We can track the physical 16" to 24" connection under T&M and pay it under Bid Item 8360 Minor Changes.

Good afternoon,
Please see attached pdf. Scarsella has brought to our attention that there is a potential grade bust with the type 2 CB on
the corner of E George st and State Ave. It would appear with the type 2 lid, risers and rim it would sit around 5" high.
There was an idea to replace this type 2 CB with a Type 1L CB.This would have plenty of room for the 12 pipe as well as
the 8" and provide a larger sump then the standard type 1 Cb. We could put a riser adapter on the CB to still have a
round locking lid as well.
Let me know if this would be acceptable or if you would like to meet in the field to go over this.

There is another issue on that project with a type 2 as well. This Is at George and State Ave. There is a 5" bust on the rim
of the frame and grate. We can alleviate that by installing a type 1L as well and still put a round locking lid on if you
would like. There is only a 12" and 8" pipe running into this structure so there will be sufficient room to do this.

structure will be on the main line. Otherwise, I'm good with replacing type 2 with type 1L CB as long as we can fit all

Good afternoon,
Please see attached pdf. Scarsella has brought to our attention that there is a potential grade bust with the type 2 CB on
the corner of E George st and State Ave. It would appear with the type 2 lid, risers and rim it would sit around 5" high.
There was an idea to replace this type 2 CB with a Type 1L CB.This would have plenty of room for the 12" pipe as well as
the 8" and provide a larger sump then the standard type 1 Cb. We could put a riser adapter on the CB to still have a
round locking lid as well.
Let me know if this would be acceptable or if you would like to meet in the field to go over this.
