Under KCC 3.70.090(A) for any public work where the cost of the complete contract is estimated to be less than the bid threshold set forth in RCW 35A.40.210 and 35.23.352 the director shall determine what competitive process the department will utilize, if any, with direct negotiation being an acceptable option; as of 2023 this threshold is $75,000 if the work involves only one craft or trade or and $116,155 if the work involves more than one craft or trade. Under Section 3.70.230(A), all purchases or work valued at an amount in excess of $20,000 must be memorialized in a written contract and signed by the mayor. The large exterior reader board at Kent Commons stopped working in early 2022 when it was discovered that the electrical meter had no power. Facilities maintenance staff called Puget Sound Energy to investigate, and it was determined that the line was broken between the transformer and the meter, responsibility for which, falls to the City. The transformer is located across James Street, so repairing the line required traffic control and locate services to determine the location of the break. It also triggered the need for engineered traffic control plans to manage traffic on James Street during construction. Facilities staff hired an electrician, Pride Electric, to perform the repair. The repair ultimately required fixes to two breaks, the street, and the sidewalk with each subsequent step requiring diagnosis and additional subcontractors to repair correctly. proved to be more complicated than anticipated, resulting in a more expensive repair. Given the unknown nature of the initial two breaks in the line and the increasing complexity of the fix that unfolded after the contractor was already hired, the cost of this project exceeded our department's spending authority. Delaying project once started wasn't a feasible approach due to the excavation required in the street and sidewalk. For these reasons, I respectfully request that you ratify the acceptance and payment of the written invoices by signing below. Thank you for your consideration.
