CONTRACT NAME & PROJECT NUMBER: Ruth Property at Clark Lake Park - Cultural Resources Assessment/CAG2022-480 ORIGINAL AGREEMENT DATE: 12/22/2022 This Amendment is made between the City and the above-referenced Consultant or Vendor and amends the original Agreement and all prior Amendments. All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows: 1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, the Consultant or Vendor shall: As described in the attached Exhibit A, incorporated herein, consultant shall conduct archaeological monitoring for the Ruth Property at Clark Lake Park. 2. Archaeology• History• Ethnography•Architectural History June 8,2023 Bryan Higgins Parks Capital Project Manager Park Planning and Dev I Parks,Recreation&Community Services 220 Fourth Avenue South Kent,WA 98032 Re: Proposal to Conduct Archaeological Monitoring for the Ruth Property at Clark Lake Park Project(RCO Project Number: 22-1478ACQ) Dear Bryan: ASM Affiliates, Inc. (ASM) is pleased to present this proposal to conduct archaeological monitoring for the above referenced project. This proposal includes a short scope of services to be provided, the estimated cost to complete the services proposed,and a schedule for completion of the project.All services will be completed in compliance with Washington State Recreation and Conservation Office (RCO) and Washington State Department of Archaeology and Historic Preservation (DAHP) standards. Additionally, as the project may include federal funding/permitting in the future all work will comply with Section 106 of the National Historic Preservation Act(NHPA). Scope of Work ASM will prepare a monitoring plan for the project for dissemination to and approval by the RCO. ASM will conduct archaeological monitoring of ground disturbing activities as stipulated in the archaeological monitoring and inadvertent discovery plan. Draft and final technical reports will be prepared to fully document the results of the monitoring in accordance with the DAHP standards and RCO requirements. Cost Estimate and Schedule ASM will conduct the monitoring project for a cost not to exceed (NTE) $24,000. ASM will prepare the monitoring plan for a fixed-fee cost of$2,500.00 and will conduct the archaeological monitoring for a fixed-fee cost of$1,500.00/day. It is assumed that a maximum of 12 days of monitoring will be required resulting in a maximum cost of$18,000 for the fieldwork. This rate is based on a 40-hour Monday through Friday work week during daylight hours. Hours worked beyond 8/day and/or 40/week will be charged at an overtime rate of $250/hour. Saturday/Sunday work and/or work conducted after daylight hours will also be charged at the overtime rate of$150/hour. ASM will complete the monitoring report for a fixed-fee cost of$3,500.00. These cost estimates assumes that no cultural resources will be encountered. If monitoring activities do encounter cultural resources a contract amendment would be necessary to cover the cost of site documentation/evaluation. ASM will submit a monitoring plan within 30 days of notice to proceed and will submit the monitoring report within 120 days of completion of construction activities. 1 hope this proposal provides the information you require and meets with your satisfaction.
