For valuable consideration and by mutual consent of the parties, the project contract is modified as follows: 1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, Contractor shall provide all labor, materials, and equipment necessary to: 1) Additional HMA patch work on 42n1J Avenue at old PRV vault location; 1 LS, $5,391.50 2) Tank stairway security improvements; 1 LS, $2,163.99, 2. The contract amount and time for performance provisions of Section II "Time of Completion," and Section III, "Compensation," are hereby modified as follows: Original Contract Sum, $8,493,470.72 (including applicable alternates and WSST) Net Change by Previous Change Orders $3412,736.27 (incl. applicable WSST) Current Contract Amount $8,906,206.99 (incl. This Change Order, unless otherwise provided, does not relieve the Contractor from strict compliance with the guarantee and warranty provisions of the original contract, particularly those pertaining to substantial completion date. All acts consistent with the authority of the Agreement, previous Change Orders (if any), and this Change Order, prior to the effective date of this Change Order, are hereby ratified and affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order shall be deemed to have applied. Reason and Back round for Change 1) Construction drawings for the PRV that was replaced on 42nd Ave only required the removal of internal piping within the vault, with the vault then backfilled in place and the old MH lid removed. During construction, it was discovered the old PRV had a bypass line that had to be removed in addition, requiring the entire vault to be demo'd out, increasing the area of surface restoration considerably. This change compensates for the increase in paving limits. 2) Tank security is paramount and vandalism concerns are on the rise. Water operations staff requested the addition of concertina wire around the barbed wire at the man gate up on the tank. This was not included in the original construction drawings. III. The extra paving was required for unforeseen challenges encountered on 42nd while putting that PRV in a year or two ago. I'm trying to get Parker to explain what happened again down there because it was before my time. This restoration work has not been done yet. It will be done when the concrete panels in Military are cured out and they can complete the rest of the paving on the shoulder of Military and the street frontage on the street in front of the tank can be done. The razor wire is an additional request by Ops for security. It's not on the original plans. Requesting approval of extra costs.
