Ms. Rolcik-Wilcox gave an update stating the City has now successfully completed acquisition with 11 property owners through direct negotiations and are working with the remaining 10 property owners. Ms. Rolcik-Wilcox shared the importance of having this Ordinance in place to maintain the project schedule should litigated condemnation proceedings become necessary. Rock Creek/SE Summit Landsburg Road Bridge - Interlocal N Agreement with King County - Approve Stephen Lincoln, Engineer III, gave an overview of the Rock Creek / SE m Summit Landsburg Road Bridge Project. Mr. Lincoln provided background to the City's 2010 agreement with the United States Department of Fish and a Wildlife and the National Marine Fisheries Service. The Rock Creek Bridge o was the last of the habitat conservation measures the City agreed to perform to improve fish habitat in exchange for support to maintain the City's o ongoing water rights at the Clark Springs Water Facility. N M L Since a portion of the bridge lies outside the Kent city limits, an agreement a with King County is needed in order to define the responsibilities for ongoing o maintenance & upkeep. An agreement was drafted where the City will maintain the bridge, King County will maintain SE Summit Landsburg Roadway. The District is proceeding through the Environmental Impact Statement process related to the preparation of a Lower Green River Corridor Plan. The goals and purposes of the plan would be to provide an integrated and reasonable long-term approach to reducing flood risks within the Lower Green River Corridor while balancing multiple objectives. These multiple objectives include salmon habitat, recreation, and equity and social justice among several others. The projected implementation period of the plan would be 30 to 50 years. The Lower Green Corridor encompasses 21 river miles through Auburn, Kent, and Tukwila, which includes 12 river miles in Kent. The Draft Programmatic Environmental Impact Statement (DPEIS) was issued on March 20, 2023, and the public comment period extends until June 19. Staff will be providing a presentation on the contents of the DPEIS. Packet Pg. 5 4.0 PUBLIC WORKS COMMITTEE Chad Bieren, P.E. 220 Fourth Avenue South KENT Kent, WA 98032 WASHINGTON 253-856-5500 DATE: May 1, 2023 TO: Public Works Committee SUBJECT: INFORMATION ONLY: Department of Ecology's Spills Coastal Protection Fund Grant Application SUMMARY: The Department of Ecology Environmental Restoration grant provides funding to local jurisdictions through the Spills Coastal Protection Fund for restoration and enhancement projects and studies. The program is funded with money collected through oil spill penalties and natural resource damage assessments. Typical projects address water quality issues and fish and wildlife habitat protection or enhancement in or adjacent to waters of the state, such as streams, lakes, wetlands, or the ocean. The McSorley Wetlands Complex Debris Removal/Site Clean-up Project qualifies for this grant. If the City is selected, grant funds would be used to pay for the cost of the debris removal and site clean-up. This proposal would benefit the McSorley Wetland by removing trash from illegal dumping and homeless encampments, which impacts habitat, soil, and water quality. Pollutants in trash can harm wetlands, salmonids in McSorley Creek and aquatic life at the mouth of the creek in Saltwater State Park. Birds and other animals are also at risk of consuming or becoming entangled in the trash. This is the City's 24t" year hosting the environmental education event and over 500 3rd and 4t" grade students from Kent School District, their teachers, and parent chaperones participated. Students learned about a variety of environmental conservation topics like water quality protection and conservation, salmon and wildlife habitat protection, and waste reduction and recycling. There were hands-on exercises related to tree planting, the water cycle, recycling, and pollution prevention. Students heard from 20 presenters, nearly half of whom were our very own dedicated in-house staff, while others included performances by an environmental magician and the Reptile Man, as well as staff from Republic Services, the Environmental Protection Agency, King County Solid Waste Division, the Puget Soundkeeper Alliance, and Soos Creek Water & Sewer District. Excellent feedback was received by City staff about the event from students and teachers. Students came away with a better understanding of how they can effectively partake in environmental protection within their schools and the community. Updated annually, as required by State code, the six-year plan for each city includes projects and programs of regional significance for inclusion in the TIP and Statewide Transportation Improvement Program. The TIP is required to be consistent with the Kent Transportation Master Plan (TMP) as an element of the City's Comprehensive Plan, with projects nominated from the TMP or included by other agencies. Including projects in the TIP allows the City to coordinate with other agencies, seek input from the public, search for funding partners, and apply for grants. Most State and Federal agencies require that projects being submitted for grants be included in the City's adopted TIP. Staff will note completed projects proposed to be removed from the TIP, and provide context and considerations for this year's update, including grants. Continuing from the March 201h, 2023 Public Works Committee meeting, an interactive GIS StoryMap is available for public engagement and feedback on the proposed TIP. The storymap can be found online here: <https://storymaps.arcgis.com/stories/38f7ff964eeb48bl9288e2l74af24014> An information display is also posted at Kent Commons, at the main entry through May 16, 2023. State law requires the City to hold a public hearing before adopting the TIP. This public hearing will be held on May 16, 2023, at the regularly scheduled City Council meeting. Any written comments sent in advance must be received by no later than 4 p.m. on Tuesday, May 16, 2023, in order to be considered. A major update of the TMP was adopted on March 2, 2021. Projects, plans and programs move from the TMP to the TIP as priority projects, grants, and other funding sources are identified. The TIP represents N Kent's current list of needed projects that are anticipated to begin preliminary engineering, right of way acquisition or construction within the next six N years. The TIP also includes ongoing citywide transportation plans and programs. Projects, plans, and programs are included in the TIP plan for a variety A of reasons. These projects, plans, and programs encompass all transportation modes as well as both capital improvements and operations and N maintenance. m The document identifies secured or reasonably expected revenues for each project or program. The TIP serves as a draft of options for the development V of the local transportation network. As adopted, the TIP guides funding and implementation priorities during the development of the transportation portion of the Six-Year Capital Improvement Program (CIP). The CIP shows the City-funded portion of projects and is constrained by current budget forecasts, whereas the TIP shows a complete project list with the variety of funding sources and partners involved. d E Historically, the largest sources of funding for TIP projects have been City finds and grants. Funding for transportation projects is available from federal, 3 state, and local resources. Each funding source has specific rules and guidelines about what types of projects it will fund, how much of a project will be C funded, and timelines for expenditure of funds. Additionally, most grant programs require a funding match, which means that the City must contribute 13 funding to the cost of the project. In order to compete for transportation funding grants from federal and state sources, granting agencies require R projects to be included in the TIP. L Cn O The City of Kent funds transportation projects using the General Fund, Street Fund, Local Improvement Districts, Transportation Impact Fees, Business d and Occupation Tax, Solid Waste Utility Tax, and grant revenue from local, state, and federal governments. One reason the TIP is updated annually is that many revenue sources are closely tied to the health of the economy and can therefore be unpredictable. In addition, grant criteria can change from E the previous cycle necessitating a re-evaluation of the TIP projects.
