For valuable consideration and by mutual consent of the parties, the project contract is modified as follows: 1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, Contractor shall provide all labor, materials, and equipment necessary to: In the PCCP roadway section, STA 26+28 to 35+10, change curb type from Cement Concrete Curb and Gutter per Kent Standard Detail 6- 33 to SDOT 410C Curb. Install PCCP under the crosswalk island at STA 30+63 to STA 31+39, and use SDOT 410C Curb in place of Traffic Curb to construct the island. Use 1.25" dowel bars in the PCCP roadway. This change order makes the following revisions to the contract documents: Revise the following bid item quantities: BI 1096 - Increase Bid Quantity from 975 CY to 1040 CY BI 1140 - Decrease Bid Quantity from 422 SY to 384 CY BI 1205 - Decrease Bid Quantity from 1600 LF to 199 LF Create the following new bid items: ADD Item Type 410C Staple Curb Incl. Also, pursuant to the above-referenced contract, Contractor agrees to waive any protest it may have regarding this Change Order and acknowledges and accepts that this Change Order constitutes final settlement of all claims of any kind or nature arising from or connected with any work either covered or affected by this Change Order, including, without limitation, claims related to contract time, contract acceleration, onsite or home office overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the Contractor from strict compliance with the guarantee and warranty provisions of the original contract, particularly those pertaining to substantial completion date. Reason and Background for Change SCI and Salinas proposed this change initially. Typical construction sequence when using cement concrete curb and gutter and PCCP roadway is to install the curb and gutter before the PCCP roadway. Using a 410C curb type allows PCCP roadway to be installed before the curb, and the curb can be installed after vehicles are using the new pavement surface. This shortens the time vehicles are traveling on the temporary gravel surface. This also creates wider outside concrete panels, going from approximately 9' wide by 12' long, to 10.5' x 12' long, creating panels closer to square in dimension, which potentially increases their strength. Under the traffic island, the use of a traffic curb would result in 6' wide x 12' long panels. KSP 5-05.3(8)require the larger dimension to be no greater than 150% of the smaller dimension. The City specified WSDOT standard 1.5" dowel bars for the PCCP roadway. The City reviewed this with their geotechnical and pavement design consultant and determined 1.25" dowels would be more appropriate for the 8.5" pavement thickness specified in the contract. The City and Contractor agreed to a credit for this change. SCI initially presented this change proposal, including the dowel bar credit, to the City with a total cost of$5,487.44. The City countered at no cost, as the per plan design has worked successfully in the past. The Contractor then agreed to make these revisions at no cost. III.
