Washington State Department of Commerce Mill Creek / 76th Avenue a South Flood Plain Stabilization, Habitat Enhancement Project a $980,000 Grant — Authorize Susanne Smith, Design Engineer III, presented the grant received by the City from the Washington State Department of Commerce for the Mill Creek / 76th Avenue South Flood Plan Stabilization, Habitat Enhancement project, in the amount of $980,000. Ms. Smith identified the location of the project and explained the grant will be used for capital expenditures, including replacing insufficient culverts, restoration of vegetation and creation of flood plain areas to reduce flood risk. James Street Stormwater Improvements - King County Flood Control District Sub-Regional Opportunity Fund acceptance - Authorize Melissa Dahl, Environmental Engineer II, reviewed how the funds from The King County Flood Control District Sub-Regional Opportunity Fund are allocated. This year the city of Kent will receive $225,308.00 from this fund. Ms. Dahl explained how these funds will be used on James Street to reduce the duration of standing water with the addition of extra drainage facilities. Construction for this project is anticipated to begin in summer 2023. INFO ONLY: Solid Waste Rate Charge Tony Donati, Conservation Coordinator, provided a brief update regarding the Solid Waste Rate Charge. Mr. Donati reminded the Committee of the rate structure, explaining rates are allowed to adjust annually per the City's solid waste contract. Residents and businesses will see a slight rate increase on N their garbage bills starting April 1, 2023. Mr. Donati stated these rates do c include garbage, recycling and yard waste. m Mr. Donati further explained the Recycle Processing Fee charged to each a customer is also adjusted yearly. Beginning April 1, 2023, this rate will be c decreased, for the second year in a row. M N Mr. Donati also mentioned several upcoming community events, including N curbside cleanups and mini recycling events. Information for these can be N found on the City website. M a F. INFO ONLY: 2024-2029 Transportation Improvement Program — Proposed Project Changes David Paine, City Transportation Planner, updated the Committee on the Transportation Improvement Program (TIP). The TIP is a six year plan, updated annually per State Code. r Mr. Paine gave a summary of where the City is in the TIP update, and discussed the process used to either add projects to the TIP or move them a from the 20 year Transportation Plan to the 6 year plan. r Mr. Paine shared a draft list of projects that are being recommended to add to the TIP, as well as 3 projects that are recommended to be removed from the TIP. SUMMARY: The City needs to acquire property rights from 21 property owners to construct the South 218th Street/98th Avenue South from 94th Place South to South 216th Street Project ("Project"). The Project will widen South 218th Street and 98th Avenue South (from 94th Place South to 98th Avenue South) to three lanes and includes paving, concrete curbs & gutters, sidewalks, paved shoulders, street lighting, storm drainage, sanitary sewer, water main replacement, landscaping, and channelization. The Project will also include undergrounding all overhead utilities to an underground Joint Utility Trench. Staff has been communicating with impacted property owners and held a public meeting for the community at Panther Lake Elementary on February 10, 2023. To date, staff has successfully negotiated acquisitions from ten property owners. Although the ordinance authorizes the City to initiate condemnation proceedings in court, this would be a last resort. The City will continue to make every reasonable effort to avoid formal condemnation. However, to maintain the schedule necessary for completion of the Project, condemnation proceedings may become necessary if negotiation efforts fail. Having the condemnation ordinance in place at this time will reduce the time required to file condemnation proceedings should it become necessary. As required by state law, notice of Council's anticipated consideration of the ordinance was mailed to the affected property owners on March 16, 2023. Notice has also been published in the Kent Reporter. BUDGET IMPACT: Property acquisition will be paid out of the Project Fund. This ordinance provides for the condemnation, appropriation, taking, and E damaging of real property necessary for that project and provides for the payment thereof out of the 224t" Corridor (94t"-99t") Phase 3 Project fund (Fund No. R90110). This ordinance also directs the City LO Attorney to prosecute the appropriate legal condemnation proceedings in King County Superior Court, to retain any legal counsel required, and to enter into settlements, stipulations, or other agreements as may be necessary. o 0 r c RECITALS E c A. The purpose of the South 218t" Street/98t" Avenue South from 0 94t" Place South to South 216t" Street Project (the "Project") is to widen a 0 South 218t" Street and 98t" Avenue South (from 94t" Place S. to 98t" Avenue a South) from two to three lanes. To complete the Project, the City must acquire certain property and/or property rights on several parcels of land. C. City staff will continue their efforts to acquire the property a� necessary for this public use by negotiation and settlement agreements; Q however, timing is critical because of funding deadlines and Project o construction costs that continue to rise due to an increase in property values 00 and inflation. N a� c D. If the necessary property rights cannot be acquired through L negotiations, it is essential that the City be prepared to initiate o c condemnation proceedings so that the Project can be timely constructed. ° c E E. Prior to Council's action on this ordinance, the City provided the requisite notice to the affected property owners in the manner provided for U in RCW 8.12.005 and RCW 8.25.290. LO M F. After receiving 00 the report of City staff, and after reviewing the planned improvements for N co the South 218t" Street/98t" Avenue South from 94t" Place South to South c 216t" Street Project ("Project"), the City Council finds and declares that the E public convenience, use, health, safety, and necessity demand that the City a a 2 Condemnation Ordinance - South 218th Street/98th Avenue South from 94t" Place South to South 216t" Street Project Packet Pg. 13 4.B.b of Kent condemn, appropriate, take, and damage certain real property located in King County, Washington, in order to acquire the necessary real property and/or property rights for the construction of the Project, including all necessary appurtenances. The property to be acquired or which property rights are to be acquired is legally described and depicted in Exhibits A Go through R (collectively, "the Property"). The precise scope of the taking may change if engineering requires modification of present plans, and such o r N changes are hereby authorized. The purposes for which this condemnation c is authorized shall include, without limitation, all acts necessary to complete the construction, extension, improvement, widening, alteration, p` r- maintenance, and reconstruction of the Project, and any other municipal g purpose that may be necessary from time to time on the Property. a� c SECTION 2. - Condemnation Authorized. The City Council U authorizes the acquisition by condemnation of all or a portion of the LO Property as may be necessary for the construction, extension, a� improvement, widening, alteration, maintenance, and reconstruction of the Project, together with all necessary appurtenances and related work to 0 make a complete improvement according to City standards. c c SECTION 3. - Condemnation Procedures and Proceedings. The City E shall condemn the Property only upon completion of all steps and procedures o U required by applicable federal or state law or regulations, and only after just a� compensation has first been made or paid into court for the owner or owners a in the manner prescribed by law. 00 SECTION 4. - Project Fund. The City Attorney or designee is authorized and directed to commence condemnation proceedings as provided by law that are necessary to acquire the Property as the Project requires. The City Attorney is specifically authorized to retain any legal counsel or other expert as may be needed, and to sign any retainer Go or other agreement that may be required. In commencing these condemnation proceedings, the City Council authorizes the City Attorney to 0 r N enter into settlements, stipulations, or agreements in order to minimize c damages. These settlements, stipulations, or agreements may include, but are not limited to, the amount of just compensation to be paid, the size and 0` dimensions of the Property condemned, and the acquisition of temporary g construction easements and other property interests as the City Attorney a) may determine are required. 0 U SECTION 6. - Ratification. SUMMARY: The Rock Creek/SE Summit Landsburg Road Bridge project replaced three undersized roadway culverts with a larger, fish-passable roadway bridge. Per an agreement with the United States Department of Fish and Wildlife and the National Marine Fisheries Service, the City agreed to perform a series of habitat conservation measures to improve fish habitat within the Clark Springs Watershed. The Rock Creek Bridge was the last of these measures. The Rock Creek Bridge was substantially completed in 2022. Some asphalt paving work will be completed this Spring. Because a portion of the new bridge lies outside of Kent city limits within unincorporated King County, this agreement is needed to outline the City's and King County's responsibilities for the maintenance, repair, and inspection of the new bridge and the roadway surface of SE Summit-Landsburg Road BUDGET IMPACT: The City's responsibilities under this agreement will be paid for by City's Water Fund SUPPORTS STRATEGIC PLAN GOAL: Evolving Infrastructure - Connecting people and places through strategic investments in physical and technological infrastructure. Together the County and the City are sometimes referred to herein as the"Parties"and individually as a"Parry". -a L m RECITALS 0 I. The Rock Creek Bridge is located over Rock Creek at S.E. The City agrees to pay for 100% of all Routine Maintenance and Major Maintenance of the Bridge Structure as described under Section II.A. above. t� C. The City and County agree to share the costs structural overlay of bridge deck as follows based on proportional ownership of the Bridge: City 77% and County 23% of all costs as described under Section III.A.4. above. LO D. The City agrees to pay for 100% of the cost to construct the Bridge and the cost to c maintain all records including the performance of studies and inspections associated with E the Bridge. INDEMNIFICATION E To the extent permitted by law, each Party to this ILA shall protect, defend,indemnify, and a save harmless the other Party, and its officers,officials, employees, and agents,while acting within the scope of their employment, from any and all costs, claims, demands,judgments, damages,or liability of any kind including injuries to persons or damages to property,which Packet Pg. 58 4.C.a arise out of, or in any way result from, or are connected to services associated with this ILA caused by or resulting from or are due to any negligent acts or omissions of the indemnifying Party. Each Party agrees that it is fully responsible for the acts and omissions of its own subcontractors,their employees and agents,acting within the scope of their employment as :2 L such,as it is for the acts and omissions of its own employees and agents. No Party shall be 00 required to indemnify, defend, or save harmless the other Party if the claim, suit, or action for 0 injuries, death, or damages is caused by the sole negligence of the Party seeking indemnification. Where such claims, suits,or actions result from concurrent negligence of the Parties,the indemnity provisions provided herein shall be valid and enforceable only to the extent of the Party's own negligence. J Each Party agrees that its obligations under this indemnification section extend to any claim, E E demand, and/or cause of action brought by, or on behalf of, any of its employees or agents. y UJ For this purpose, each Party,by mutual negotiation,hereby waives,with respect to the other Party only, any immunity that would otherwise be available against such claims under the industrial insurance provisions of Title 51 RCW. t� In the event of any claims,demands,actions and lawsuits,the indemnifying Party upon prompt notice from the other Party shall assume all costs of defense thereof, including legal fees incurred by the other Party, and of all resulting judgments that may be obtained against M the other Party.
