MEMORANDUM OF AGREEMENT
by and between the
CITY OF KENT
and
KENT POLICE OFFICERS ASSOCIATION
Representing the
POLICE SERGEANTS AND OFFICERS
Regarding
ARTICLE 6 - SICK LEAVE
This Memorandum of Agreement ("MOA") is entered into by and between the City of
Kent ("the City") and the Kent Police Officers Association, representing the Police
Sergeants and Officers' bargaining unit (referred to herein as "KPOA"), to amend
Section 6.6 of the collective bargaining agreement ("CBA").
Background
The City and the Union are parties to a collective bargaining agreement ("CBA")
effective January 1, 2022, through December 31, 2024.
Article 6, Section 6.6 of the parties' CBA describes the sick leave incentive pay that
applies to Officers and Sergeants who have a certain number of hours in their sick
leave bank. This MOU cleans up the language by adding in the 1150 tier to the
language. This is consistent with what was discussed during the CBA negotiations.
As a result, the parties have met and agreed to clean up the language, and this MOA
formally amends "Article 6, Section 6.6 - Sick Leave Incentive/Buy-Out Program" of
the CBA to implement the revisions as provided for in this MOA.
Agreement
The parties agree as follows:
1. Article 6, Section 6.6 of the CBA, entitled "Sick Leave/Buy-Out Program," is
amended by implementing the following revision to subsection (B) as follows:
B. Compensation shall be made no later than January 20 of the following
year and shall be at the employee's hourly rate in effect at the time
the compensation is made. For purposes of determining eligibility
to receive incentive pay an employee must be at 480, 720, 960, er
1040, or 1150 hours of accrual on December 15th of that year.
2. All other provisions of Section 6.6, and the remaining language of the CBA,
shall remain in full force and effect and shall not be altered by this MCA.
3. This MCA was prepared and/or reviewed by both parties. In the event of an
ambiguity in any term of this MOA, it shall be interpreted evenly, and not
against the drafter of the MCA. The principle of contra proferentem shall not
apply.
4. The parties agree that upon execution, the change implemented by this MCA
shall apply as of January 1, 2022.
By signing below, the parties agree that the above represents the parties' full and
entire agreement with respect to the subject matter of this MCA, and this MCA shall
be deemed executed and effective as of the last date signed below.
