This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Repair the streambed under the culvert on 218th Street due to it being
washed away.
2. The contract amount and time for performance provisions of Section II "Time of
completion," and section III, "compensation," are hereby modified as follows:

In accordance with Sections L-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract,
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

During a routine inspection it was discovered that streambed rock under the 218th culvert had washed
away. City staff optained the necessary permits and requested a quote from Scarsella. Scarsella
provided a lump sum price of $20,000.00 and the City agreed to move forward. Scarsella crews
supplied and installed stream bed rock under the culvert.

Garrison Creek Culvert at 218th Street - Action ltem Recap
Hi Everyone,
These are the action items for the Garrison Creek Culvert at 218th Street:
. Steve will reach out to Joe to get the video surveys for the storm system in the area.. Scarsella and Operations will be on site tomorrow to vactor out the mud from the
diversion structure so that Scarsella can see how water is entering the riser below the
overflow.. Jason will get Scarsella's observations.. The water that is seeping from culvert appears potable water, Carla will check with David
Shearer on what his opinion is on the risks.. Erosion appears to be the result of slumping that follows high-water events, Steve will
look into riprap placement and will discuss with Joe and operations.. We will have a follow-up meeting next Wednesday at 11:30.
If I am missing anything, please respond to this message. If you have any questions, I will be
happy to answer them.

The expedited HPA has been submitted, and I have spoken with Julian he is now expecting the
HPA. He has suggested that we reach out to King County Wastewater about this repair in the
vicinity of their crossing, as this may encourage them to expedite their plans for the future
undergrounding of the pipe.

He believes he should be able to get us the HPA in time work getting the work down next week.
I will update you after Julian has gotten back to me with his initial review.

I just left a voice mail outlining our HPA needs for the Garrison Creek Culvert with Julian at
WDFW. I told him that we will be placing 30-40 CY of streambed cobbles to arrest erosion at the
bridge footings. I informed him that he should anticipate receiving the expedited HPA today and
to call me back as soon as possible so that we can discuss it.
In the meantime, I will be submitting expedited HPA request with some of our photos, and a
mark-up of the channel cross section showing the limits of cobble placement.
I will update you once Julian calls back.

I got a call back from Julian, he is in the process of processing our application, he noted that by
statute, our expedited HPA can be issued as far out as October L4, in that case he will give us a
work window from the date of issuance rather than our requested start date.
I have provided him with Jason's email and phone number in case he has questions, and also to
provide Jason with the HPA if issued while I am out of town.
If you have any questions, I will be happy to answer them.

of the scouring issues beneath our new bridge over Garrison Creek on 218th St. They have
located material and are ready to proceed once we agree to their proposed pricing and we
receive the permit.
Jason and I feel the proposed price is reasonable and the materials/methods proposed are
consistent with those discussed in the field with our staff.
Are you okay with proceeding with a change order for $20,000 to complete this additional work?
