In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above -referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.

I. Proposed Change
This change makes the following revisions to the Contract Documents and provides compensation for
added work:
In accordance with Revision 3, add seven (7) speed cushions, one ADA sidewalk ramp, one raised
crosswalk, one traffic island, and perform all of the associated sign relocations/installtions, pavement
markings, channelization, and other work necessary for for their completion, all near Lake Meridian
along 144th Ave SE and SE 263rd St. Total cost of this change order is $95,980.00.
II. Reason and Background for Change,
Revision 3 is the addition of traffic calming elements in the way of seven speed cushions, a raised
crosswalk, one ADA ramp, a traffic island, and associated other work near Lake Meridian (along 144th
Ave SE and SE 263rd St), all deemed necessary by City of Kent Public Works Traffic Engineering. This
determination was achieved following community feedback and traffic studies. These changes were
reviewed by Public Works management and approved for construction.

Lakeside has provided the attached unit price proposal for Revision 3 on our 2022 Overlay
project. The proposal was initially received prior to staff being directed to add the 7th speed
cushion. As a result the proposal was marked up (attached for reference) and agreed to by
Lakeside. The total proposed price is $95,530.00. Are you okay with proceeding with preparing

Please see the attached pricing for the proposed CO-4 (revision 3). The markups are based on
our direction to add in the amended sheet 41 of revision 3 (adding the speed cushion near the
boat launch). Lakeside has agreed to honor the previously approved unit prices, I just adjusted
the quantities to match the updated revision.

Shaun had sent over pricing for Revision 3, last week. I know he's out of the office for a bit, so I
figured I would send this to you. The City has updated sheet 41 by adding another speed
cushion. Can you take a look at that and revise the pricing? Also, the previous signage quantity
showed 16 "new" signs, but there were only 14 new signs, with 2 being relocated. Take a look
and let me know what you think. Thank you!
