This Change Order amends the above -referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
Create an 80/HR Traffic Control Labor payment item. Crew consists of
1-TCS and 2-Flaggers for a duration of 30, 8-hr working days. Traffic
Control Labor is required to support safe site construction and efficient
vehicle access to Summit Trail Middle School during TSD's calendar
year. Costs include labor, vehicles and misc. equipment related to the
flagging effort.
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above -referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

This unit price change makes the following revisions to the Contract Documents and provides
compensation for added work:
Create an $80/HR Traffic Control Labor payment item. Crew consists of 1-TCS and 2-Flaggers for a
duration of 30, 8-hour working days. Traffic Control Labor is required to support safe site construction
and efficient vehicle access to Summit Trail Middle School during Tahoma School District's calendar year.
Costs include labor, vehicles, and miscellaneous equipment related to the flagging effort.

Summit Landsburg Road was originally planned to be constructed under a full road closure. Following
award, it was determined the road must remain open during the Tahoma School District calendar year, it
could only be closed during summer vacation. The original contract included a Lump Sum payment item
for Traffic Control. This change provides a payment mechanism for previously unaccounted traffic control
labor necessary for safe construction of the roadway under vehicle traffic. This change also includes
flagger support at Summit Trail Middle School while the roadway is in a northbound only restriction.

Hello Kelly,
Please see the below email concerning payment for flaggers during the remainder of the project
while crews are working under traffic. We would like to set up a unit -price change order for
$80/hr with a projected 650 hours...Total=$52,000.00. With executed Change Orders 1 through
3, this would put our total CO's for the project at $260,041.95 (base contract amount is
$2,288,875.34). Proposed cost for the PSE utilities crossing beneath the bridge should also be
in consideration for a future change order as well in the amount of $22,100.
Are you okay with proceeding with a unit price change order to compensate for this additional
traffic control cost?

Hi Eric,
A pay item for flagging was not included on this contract and that fact was not recognized until
after CO #1 was negotiated. The project requires active flagging while traffic is allowed to use
the site and a CO adding Flagging/Hr must be created.
Attached is Scarsella's cost proposal for flagger hours. The projected 650 hours is basically 2
flaggers(one who is a TCS) per day, 8 hours per day, for 8 weeks. The $80/hr is within the

ballpark of recent bid amounts for flagging/tcs. These hours will be used to support ongoing
construction as well as support peak ingress/egress at the middle school while the project is
under one-way traffic.
Let me know if this is acceptable and I will prepare the CO.

Yes, give me a price per hour (let's say 650 Hours, get us through October) and I'll see about
writing a CO... making the signaled two-way system look cheap. Unfortunately, I think we've
gone too far down the northbound only road thing with KC and School and I still think we'd need
flaggers during work hours with 2-way signals. Signals will back things up too much during peak
hours and we need spotters with work going on... so here we are.

The City had our Traffic Control consultant look at the northbound only traffic control scenario
and attached are the plans they came up with. Phil and I have redlined them.
Can you please have your sign supplier prepare 3 ea AT ROCK CREEK placards and 3 ea of the
signs shown on sheet .02 in preparation of next Tuesday's one lane opening. Since we do not
have unit price bid items for flaggers or Class A signs, we'll track work on FA along with the
three additional school signs already ordered.
