CALL TO ORDER Council President Troutner called the meeting to order. 2. AGENDA APPROVAL No changes were made to the agenda. 4. DEPARTMENT PRESENTATIONS A. Payment of Bills - Authorize MOTION: Approve the payment of bills received through 5/15/21 and paid on 5/15/21 and approve the checks issued for payroll 5/1/21-5/15/21 and paid on 5/20/21, all audited by the Committee of the Whole on 5/25/21. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 6/1/2021 7:00 PM B. U.S. Department of the Treasury Coronavirus Local Fiscal Recovery Funds - Authorize Finance Director, Paula Painter presented details on the U.S. Department of the Treasury Coronavirus Local Fiscal Recovery Funds and advised the City needs to authorize the Mayor to sign the documents to receive the funds from the Federal Government that will be distributed in 2021 and 2022. Kent City Council - Committee of the Whole May 25, 2021 Committee of the Whole - Regular Meeting Kent, Washington Minutes The City can expend the funds on public health, negative economic impacts due to COVID, loss of revenue and can invest in infrastructure - water/sewer/broadband. The City has put together a committee to set up the framework on how to spend funds and should have a proposal to bring to the June 8th Committee of the Whole. MOTION: Move to authorize the Mayor and/or Finance Director to sign agreements necessary to accept the American Rescue Plan Act funds from the U.S. Department of the Treasury, which will include, but is not limited to the Coronavirus Local Recovery Fund Acceptance of Award Terms for the maximum amount allocated to the City of Kent, subject to final terms and conditions acceptable to the Finance Director and City Attorney. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 6/1/2021 7:00 PM C. INFO ONLY: House Bill 1220 Long Range Planning Manager, Hayley Bonsteel presented to Council House Bill 1220 which supports emergency shelters and housing through local planning and development regulations. Bonsteel began by providing a summary of bill components and changes to comprehensive plan requirements. She also discussed indoor emergency housing/shelters and a new zoning requirement effective September 30th in which the City can't prohibit indoor shelters in any zones where hotels are allowed unless there is an ordinance in place authorizing indoor shelters "in the majority of zones within 1 mile proximity to transit." Bonsteel discussed reasonable requirements on indoor shelters/housing and how cities may impose "reasonable occupancy spacing, and intensity of use requirements". She indicated that existing regulations adopted in May of last year may not need to change in order to comply. Permanent supportive housing is essentially multifamily or mixed use from a land use/architectural perspective. The new zoning requirement around Permanent Supporive Housing states cities cannot prohibit Permanent Supportive Housing in any zones in which residential dwelling units or hotels are allowed. Bonsteel reviewed some foreseeable issues and indicated that staff will continue to explore Permanent Supportive Housing as it applies to the City of Kent. Bonsteel wrapped up by discussing other aspects of House Bill 1220. She Page 2 of 7 Kent City Council - Committee of the Whole May 25, 2021 Committee of the Whole - Regular Meeting Kent, Washington Minutes strongly encouraged discussion around policies encouraging ADU construction and indicated she will take these suggestions into account during the ADU portion of the upcoming middle housing code amendment. D. Kent Housing Options Plan - Adopt Long Range Planning Manager, Hayley Bonsteel presented to Council the Kent Housing Options Plan. She reviewed the timeline of the Plan, which includes adoption on June 1, 2021. Planner, Kaelene Nobis reviewed the opportunities to revise policies in the Comprehensive Plan, Development regulations and regional policies. Bonsteel went over details on the introduction, gathering data about housing needs, housing policy analysis, community and stakeholder engagement, evaluating and prioritizing housing strategies, funding mechanisms, strategic policy objectives and actions and finally the implementation of the plan. Bonsteel talked about the importance of CBO partnerships and the benefits of utilizing existing relationships and extended networks. Bonsteel provided an overview of the Mobile Home Park Preservation Study. Bonsteel went over the Strategic Policy Objective 11 - Preserve the affordable housing options in Kent while preventing mitigating displacement, Strategic Policy Objective 21 - while increasing housing variety and choice, Strategic Policy Objective 31 - Leverage and expand partnerships to further housing-related goals, and Strategic Policy Objective 41 - collaboration with the South King County subregion Bonsteel noted that Kent received approval of the draft plan by the Department of Commerce on April 30, 2021 and a public hearing was held during the May 10, 2021, Land Use and Planning Board meeting. The Board recommends council adopt the Kent Housing Options Plan. Councilmember Larimer requested Strategic Policy Objective 1-8 be amended as follows: Current version: Streamline processes for people applying for rental assistance to ensure equitable access by exploring innovative partnerships and technology solutions, including but not limited to a centralized online location managed by the City for all housing-related resources. Repeal Ordinance 4399/Chapter 10.03 KCC Which Established 40-Day Additional Notice for Termination of Month-to-Month Rental Agreement - Adopt City Attorney, Pat Fitzpatrick provided details on the Ordinance Repeal Ordinance 4399/Chapter 10.03 KCC Which Established 40-Day Additional Notice for Termination of Month-to-Month Rental Agreement. The Washington State Legislature amended the Landlord Tenant Act and -to-month lease without just cause. Engrossed Substitute House Bill 1236 had two major impacts on -day timeline in state law that formed the basis cause requirements of ESHB 1236 establish timelines that are, in some cases, repealed. INFO ONLY: Closure of 100th Place S.E. to Motorized Vehicle Traffic Parks Planning and Development Manager, Terry Jungman provided Council with an update regarding the closure of 100th Place SE to motorized vehicles. He spoke about the recent Mill Creek Canyon clean-up work that started back in September of 2020 and was wrapped up on May 14, 2021. Jungman discussed the ongoing trail repair and maintenance work that is being done by both the EarthCorps as well as the Parks Maintenance team. He indicated that the permanent road closure will be posted in the Seattle Times. He also noted that this closure is just for motorized vehicles and the road will be preserved for pedestrian and bike use. Jungman provided an example of the permanent road closure that was done at Meridian Glen Park - 137th Avenue S.E. G. Consultant Services Agreement with Jacobs Engineering Group, Inc for the Green River Natural Resources Area Stormwater Pump Station Project - Authorize Senior Environmental Engineer, Toby Hallock presented the Green River Natural Resources Area North Stormwater Pump Station with Jacobs Engineering Group for design of the pump station. Hallock indicated the installation of the pump station will help alleviate flooding throughout the Valley. MOTION: Move to Authorize the Mayor to sign a Consultant Services Agreement with Jacobs Engineering Group, Inc. for the Green River Natural Resources Area North Stormwater Pump Station project, in an amount not to exceed $280,782.92, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 6/1/2021 7:00 PM H. 2021 Street Sweeping Services Agreement with McDonough and Sons, Inc - Authorize Streets and Vegetation Manager, Bill Thomas presented the 2021 Street Sweeping Services Agreement with McDonough and Sons. Thomas began by providing a brief history of street sweeping in the City of Kent. He noted that there are 476 miles of curbs and reviewed the street sweeping schedule. MOTION: Move to authorize the Mayor to sign a Street Sweeping Services Contract with McDonough and Sons, Inc., in an amount not to exceed $20,250 per month, plus premium services and extra call-out charges, for Street Sweeping services, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. Summit Landsburg Road Puget Sound Energy Electrical Agreement - Authorize Public Works Engineer, Stephen Lincoln presented to Council the Puget Sound Energy Construction Agreements for the Summit Landsburg Road culvert replacement at Rock Creek. He reviewed the location of this project and noted that this project will replace existing culverts with a bridge. Lincoln also discussed the location of the new gas and electric lines. MOTION: Move to authorize the Mayor to sign an Electrical Relocation Agreement for $157,669.86 with Puget Sound Energy for the Rock Creek Culvert Replacement at Summit Landsburg Road, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. Summit Landsburg Road Puget Sound Energy Gas Agreement - Authorize Public Works Engineer, Stephen Lincoln presented to Council the Puget Sound Energy Gas Agreement for the Summit Landsburg Road culvert replacement project at Rock Creek. South 212th Street Preservation Puget Sound Regional Council Grant Acceptance - Authorize Public Works Engineer, Drew Holcomb discussed the addition of $700,000 to the $1.4 million of federal grant funds obligated in July of 2019 for the expenditure of the South 212th Street Overlay - East Valley Highway to 72nd Avenue project.
