CALL TO ORDER Council President called the meeting to order. 2. AGENDA APPROVAL Chief Administrative Officer, Derek Matheson indicated that there are no changes to the agenda and noted that the executive session is expected to last 10 minutes. 4. DEPARTMENT PRESENTATIONS A. Resolution Authorizing Annual Participation in Main Street Tax Incentive Program with Kent Downtown Partnership - Adopt Chief Administrative Officer, Derek Matheson presented a resolution to Council that would authorize the annual participation in the Main Street Tax Incentive Program with the Kent Downtown Partnership. This program provides B&O and Public Utility Tax credit for contributions to downtown organizations and allows the taxpayers to receive a 75% credit on their state tax payments for the following year. The resolution proposes the City make a new contribution each year to the Kent Downtown Partnership (KDP) in an amount identified by the KDP, and agreed to by the City, while also reducing its current annual contract payment for services to KDP by an amount equal to 25% the new contribution. Kent Downtown Partnership's Executive Director, Gaila Gutierrez provided Kent City Council - Committee of the Whole March 9, 2021 Committee of the Whole - Regular Meeting Kent, Washington Minutes some background on the Main Street Tax Incentive Program and how beneficial it is to the Kent Downtown Partnership. She also provided information on what the funds from this program are used for. MOTION: Adopt Resolution No. 2021, authorizing annual participation in the main street tax incentive program with the Kent Downtown Partnership, authorizing the Mayor to contribute up to the maximum permitted by the program, and authorizing the Mayor to enter into an agreement with the Kent contribution with terms and conditions acceptable to the City Attorney. INFO ONLY: Equity Strategic Plan Update Race and Equity Manager, Uriel Varela presented the Race and Equity Strategic Plan Update. He reviewed the Limited English Proficiency Plan for translation and interpretation services and the work that has gone into looking at both federal and case law as well as an analysis to determine language assistance measures needed in the City. Varela will return to Council with a update on this portion of the plan. Varela discussed the review of the Human Resources hiring process and determined some current practices are in line with best practices but there are always additional best practices to take into consideration. Next steps are on feasibility, creation of technical guides for departments and implementation. Councilmembmer Boyce requested that along with recruiting a diverse population of employees here at Kent, we work on ensuring their longevity with the City of Kent. Lastly, Varela discussed the Community Immersion Law Enforcement Project and provided a program overview. The goals of this program are to engage officers with the community, develop community-centered law enforcement practices, allow officers mentorship from community leaders and create personal relationships between officers and community members. Next steps are to finalize the program design, create an application process, incorporate data collection and evaluation instruments and recruit community-based organizations. Councilmembers Boyce, Fincher and Larimer recognized that work that Page 2 of 6 Kent City Council - Committee of the Whole March 9, 2021 Committee of the Whole - Regular Meeting Kent, Washington Minutes has gone into Race and Equity Strategic Plan is immense and inquired about additional resources available to assist in projected timeline or adjust it with all things considered. Matheson indicated that they will be utilizing some of the consulting dollars previously approved by Council to assist with community outreach. C. Payment of Bills - Authorize MOTION: Authorize the payment of bills received through 2/28/21 and paid on 2/28/21 and approve the checks issued for payroll 2/16/21-2/28/21 and paid on 3/5/21, all audited by the Committee of the Whole on March 9, 2021 RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 3/16/2021 7:00 PM D. INFO ONLY: Fourth Quarter 2020 Investment Report Senior Financial Analyst, Joe Bartlemay reported out the fourth quarter 2020 investment report. He started by providing an overview of the City's investment portfolio and then took a deeper dive into each investment types month and quarter ending balances. Bartlemay discussed the quarterly interest earnings by comparing 2019 and 2020 quarters. He also reviewed with Council the portfolio summary and statistics provided by PFM, the City's asset management company. E. Park Impact Fee and Recreation Facilities Ordinance - Adopt Kent Parks, Recreation and Community Services Deputy Director, Brian Levenhagen and Economic and Community Development Senior Planner, Jason Garnham presented to Council the Park Impact Fee and Recreation Facilities Ordinance. This ordinance would adopt a Parks Impact Fee to accommodate the increased park capacity required to meet the demands of a growing community and to provide additional funding for public park investments. This fee is supported by City plans and policies and is calculated using methods that are standard in the industry. Levenhagen reviewed the strategic goals and engagement behind the adoption of the Parks Impact Fee. He also discussed the impact fee study done by the FCS Group, as well as the impact fee schedule. Garnham reviewed the recreation facilities existing standards per Kent City Code 12.04 and what they would be with the proposed amendment. He also reviewed miscellaneous adjustments being made with the ordinance being presented. Page 3 of 6 Kent City Council - Committee of the Whole March 9, 2021 Committee of the Whole - Regular Meeting Kent, Washington Minutes MOTION: Adopt Ordinance No. 4398, enacting Chapter 12.16 of the Kent City Code imposing park impact fees in accordance with the 2021 City of Kent Park Impact Fee Study, and amending Chapters 12.04 and 15.09 of the Kent City Code to revise the recreation and open space requirements for subdivisions and multifamily projects, as presented by staff. Resolution Amending Kent City Code Fees - Adopt Senior Transportation Planner, April Delchamps presented to Council a Resolution that would repeal and readopt the City's fee schedule due to the recent updates to the administrative fees for the Transportation Impact Fees, and the addition of the Parks Impact Fees. She noted that the other fees remain unchanged. MOTION: Adopt Resolution No. 2022, repealing Resolution No. 2009 and readopting the existing fees with the addition of fees associated with the administration of impact fees. RESULT: RECOMMENDED TO COUNCIL BY CONSENSUS Next: 3/16/2021 7:00 PM G. Ordinance Establishing 40-Day Additional Notice for Termination of Month-to-Month Rental Arrangement - Adopt City Attorney, Pat Fitzpatrick presented Council an ordinance that would adopt a new chapter 10.03 to the Kent City Code establishing a 40-day notice requirement before a landlord issues a 20-day notice of termination of a month-to-month rental arrangement. Fitzpatrick indicated that a short 20- day period before a residential tenant is required to vacate has the potential especially when occupancy rates are high and housing is difficult to find. Language barriers may exacerbate the difficulty presented by the 20-day period. This ordinance will require a landlord provide to the tenant a written of RCW 59.18.200(1)(a) for the issuance of the 20-day notice of termination. Councilmembers Larimer and Fincher discussed the importance of passing this ordinance and how residents have been impacted by notices of termination. Councilmembers Larimer and Michaud expressed concerns about the waiver of notice. Fitzpatrick indicated he would draft language surrounding those concerns. Fitzpatrick indicated that the effective date being so far out should appease those concerns, but also noted that there are no guarantees with the law. MOTION: Adopt Ordinance No. 4399, adopting a new chapter 10.03 to the Kent City Code which establishes a 40-day notice requirement before a landlord issues a 20-day notice of termination of a month to month rental arrangement. Amendment with Axon Enterprise, Inc for Additional Body Worn Cameras - Authorize Kent Police Department Assistant Chief, Eric Hemmen presented to Council a contract amendment with Axon Enterprises, Inc. to purchase 40 additional body worn cameras, with associated software, equipment, and licenses for a total cost of $442,982.95 through the contracts five-year term, amend the budget, and authorize future purchases through the existing contract so long as those purchases can be made within established budgets. MOTION: Authorize the Mayor to sign a contract amendment with Axon Enterprise, Inc. to purchase 40 additional body worn cameras, with associated software, equipment, and licenses for five year term, amend the budget, and authorize future purchases through the existing contract so long as those purchases can be made within established budgets, with terms and conditions acceptable to the Police Chief and City Attorney. Ordinance Amending Chapter 6.02 of the Kent City Code to Adopt 2021 Design and Construction Standards - Adopt Public Works Engineer, Susanne Smith provided a presentation to Council on an ordinance that would amend Chapter 6.02 of the Kent City Code by adopting the 2021 Design and Construction Standard. The purpose of this update is to revise these Standards, so that they conform with changes in state and local regulations, industry standard construction techniques and materials that have occurred since the last update in 2009. Traffic Signal Warehouse Lease Agreement - Authorize Transportation Engineering Manager, Rob Brown presented to Council a lease agreement for the traffic signal warehouse. Brown discussed how the Public Works Department has leased this warehouse space for the traffic signal technicians since 2006. The lease provides traffic signal technicians a space to store equipment and parts for the traffic signal system, as well as test and repair of controllers and other electronic devices. There is no space in existing, city-owned facilities to house these operations. He noted that the existing lease expires at the end of May 2021 and requested Council approve entering into a 36-month lease. MOTION: Authorize the Mayor to sign all necessary documents to lease warehouse space for 36 months at the Plemmons Industrial Park for traffic signal system storage and workspace, subject to final terms and conditions acceptable to the City Attorney and Public Works Director. RCW 42.30.110(1)(f) - To Evaluate Complaints Brought Against a Public Officer At 5:50 p.m., Council entered executive session to evaluate complaints brought against a public officer and lasted for 10 minutes.
