Public Recognition 1. Proclamation for Holodomor Genocide Remembrance Month Mayor Ralph presented the Proclamation for Holodomor Genocide Remembrance Month to Valeriy Goloborodko and Goloborodko accepted the proclamation as a Kent community member on behalf of Kent’s Ukrainian community. 2. Proclamation for Audrey Powers Day Mayor Ralph presented the Proclamation for Audrey Powers Day. 3. Proclamation for Transgender Day of Remembrance Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 2 of 10 Mayor Ralph presented the Proclamation for Transgender Day of Remembrance to Taffy Johnson. Johnson spoke to the importance of the commemoration that honors the memory of transgender people whose lives have been lost to senseless violence, transphobia, self-harm and structural inequities. 4. Appointments to the Kent Arts Commission Mayor Ralph requested the Council confirm the appointments to the Kent Arts Commission. 5. Reappointments to the Kent Arts Commission Mayor Ralph requested the Council confirm the reappointments to the Kent Arts Commission. 6. Reappointment to the Land Use and Planning Board Mayor Ralph requested the Council confirm the reappointment to the Land Use and Planning Board. 7. Appointment to the Lodging Tax Advisory Committee Mayor Ralph requested the Council confirm the appointment to the Lodging Tax Advisory Committee. B. Community Events Council President Toni Troutner announced upcoming events at the accesso ShoWare Center. Fincher advised of upcoming Spotlight Series events. Visit Kentwa.gov for information on shows and tickets. Mayor Ralph advised of the upcoming Kent Winterfest 2021. The City has partnered with the Kent Lions, Kent Downtown Partnership and Kent Station to present a month of holiday fun. C. Public Safety Report Assistant Chief Eric Hemmen presented the Public Safety Report. Hemmen presented the Chief's Award for Citizen Commendation to Jessy Warmington for her selflessness, dedication and organizational skills that kept the spouses group moving forward. Hemmen reviewed the calls for service and compared 2020 to 2021 and provided an update on the newly-implemented 12-hour shifts. 5. REPORTS FROM COUNCIL AND STAFF A. Mayor Ralph's Report Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 3 of 10 Mayor Ralph serves as the Chair of the Sound Cities Association Puget Sound Regional Council Transportation Policy Board. The Board recently heard reports on the Transit Integration Report and the Regional Transportation Plan. The Board wrapped up the Project Selection Task Force that has been meeting since February setting criteria for grants being made with federal funds. Mayor Ralph serves on the South County Area Transportation Board that heard an update on the air cargo division at the SeaTac airport. Mayor conveyed that King County has implemented a mandate on vaccinations - it is not a City of Kent mandate. B. Chief Administrative Officer's Report Chief Administrative Officer Derek Matheson advised of the scheduled City Council meetings through the end of 2021 and advised that the Operations and Public Safety Committee will meet on the first Tuesday and the meeting on the third Tuesday may be cancelled. Matheson advised of the new employees in the Administration Department. Matheson indicated there is no executive session tonight and his written report is included in the agenda packet. C. Councilmembers' Reports Council President Troutner provided information on the two workshop presentations on Parks Capital Projects and a Public Works update on the Green River Flood Protection. Troutner serves on the Sound Cities Association Regional Transit Committee that will meet on November 18th to review service guidelines before submitting to the Regional Transit Committee for a vote. Councilmember Boyce serves as the Chair of the Economic and Community Development Committee and provided an update on the meeting agenda from November 8th. Boyce serves as the Vice Chair for the Sound Cities Association Public Issues Committee that will hold their annual meeting on December 1st. Councilmember Fincher serves as the Chair of the Sound Cities Association King Conservation District Advisory Committee. KCD elections should be moved to the regular King County ballot. Visit KingCD.org for information. Councilmember Fincher serves on the Kent Arts Commission and advised of upcoming Spotlight Series events. Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 4 of 10 Fincher serves as the Chair of the Public Works Committee and provided a recap of the November 15th meeting agenda. Fincher serves on the Mental Illness and Drug Dependency Advisory Council that recently discuss HB1310 and 1477 - both relating to co-responder models. The Council also received a report from the Crisis Solution Center. Councilmember Kaur serves on the Sound Cities Association Domestic Violence Initiative Regional Task Force that recently met and received a presentation from the Washington State Domestic Violence Coalition on economic hardships and impacts on domestic violence victims. Legislative priorities were discussed that included housing, economic justice, re-entry and reduced sentencing for victims. Councilmember Thomas serves on the Puget Sound Regional Fire Authority Governance Board that will meet on November 17th at 5:30 p.m. via zoom. Call 253-856-4300 for information. Councilmember Larimer serves on the Sound Cities Association Advisory Council on Aging and Disability Services that recently heard a presentation from the Task Work Group made up of Legislators and advisors that are working on updating the tax structure. Visit taxworkgroup.org for more information. 6. PUBLIC HEARING None. 7. PUBLIC COMMENT Lynne Saboe, a Kent business owner thanked the Council for not defunding the Police Department. Saboe also expressed concerns over crime and issues with the homeless in the area surrounding her business. Saboe requested the Council, Mayor and Police work with business owners to come up with solutions to the growing crisis. David Kramer, a Kent business owner and Kent resident, expressed concerns over crime and the failure to prosecutor criminals. Kramer requested the Council push hard in Olympia to get the laws changed to protect the community from those repeatedly committing crimes. John Scully, a Kent business owner, pleaded for the Council to help businesses address criminal activity of the homeless in the downtown area. Ari Derbedrossian, a Kent business owner, requested the Council visit the downtown area around Central and Willis so they can witness the drug Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 5 of 10 dealing and other criminal activity and to also take action to address the criminal activity to help the local business owners. 8. Payment of Bills - Authorize MOTION: I move to authorize the payment of bills received through 10/31/21 and paid on 10/31/21 and approve the checks issued for payroll 10/15/21 - 10/31/21, all audited by the Operations and Public Safety Committee on 11/2/21. C. Accept the 125K Reservoir Recoating and Fall Protection Improvements Project as Complete - Authorize MOTION: I move to authorize the Mayor to accept the 125K Reservoir Recoating and Fall Protection Improvements Project as complete and release retainage to HCI Industrial & Marine Coatings, Inc. upon receipt of standard releases from the State and the release of any liens. D. Reappointment to Kent's Land Use and Planning Board - Confirm MOTION: I move to confirm the reappointment of Shane Amodei to a second three-year term on the Kent Land Use and Planning Board that will begin on January 1, 2022 and end on December 31, 2024. E. Reappointments to the Kent Arts Commission - Confirm MOTION: I move to confirm the Mayor’s reappointments of Christy Caravaglio and Hal O’Brien to second four-year terms on the Kent Arts Commission that will begin on November 16, 2021 and end on November 15, 2025. F. Appointment to Kent's Art Commission - Confirm Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 6 of 10 MOTION: I move to confirm the Mayor’s appointment of Jennifer Treese, Countess Stekovic, Bryan Ohno, and Kerry French to four-year terms on the Kent Arts Commission that will begin on November 16, 2021 and end on November 15, 2025. G. Appoint Alternate to Kent's Arts Commission - Confirm MOTION: I move to confirm the Mayor’s appointment of Ryan Olmsted to a four-year term as an alternate to the Kent Arts Commission. The term will begin on November 16, 2021 and end on November 15, 2025. H. Appointment to Lodging Tax Advisory Committee - Appoint MOTION: I move to appoint Gaila Haas to the Lodging Tax Advisory Committee for a 3-year term starting on January 1, 2022 and ending December 31, 2024. I. 2022 Legislative Agenda - Adopt MOTION: Adopt the City of Kent’s 2022 state legislative agenda. J. Government Affairs Contract-Second Amendment - Authorize MOTION: Authorize the Mayor to sign a Second Amendment to the Consultant Services Agreement with Gordon Thomas Honeywell Government Affairs, subject to final terms and conditions acceptable to the Chief Administrative Officer and City Attorney. K. Consolidating Budget Adjustment Ordinance for Adjustments between July 1, 2021 and September 30, 2021. MOTION: I move to Adopt Ordinance No. 4413, approving the consolidating budget adjustments made between July 1, 2021 and September 30, 2021, reflecting an overall budget increase of $13,102,218. L. Comprehensive Plan Amendment – 2022-2027 Capital Improvement Program – Ordinance – Adopt MOTION: I move to adopt Ordinance No. 4414, amending the Capital Facilities Element of the Kent Comprehensive Plan to include the 2022-2027 Capital Improvement Program. M. Ordinance Amending the Comprehensive Plan to Adopt the Capital Facilities Plans of the Kent, Auburn, and Federal Way School Districts - Adopt Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 7 of 10 MOTION: I move to adopt Ordinance No. 4415, amending the Capital Facilities Element of the Comprehensive Plan by adopting the Kent, Auburn, and Federal Way School Districts’ 2022-2027 Capital Facilities Plans. N. Ordinance Adopting Updated School Impact Fees - Adopt MOTION: I move to adopt Ordinance No. 4416, amending Section 12.13.160 of the Kent City Code to adjust the school impact fee schedules for the Kent, Auburn, and Federal Way School Districts. O. Ordinance Amending the Comprehensive Plan to Adopt the Puget Sound Regional Fire Authority’s 2022-2027 Capital Improvement Plan and Updated Impact Fees - Adopt MOTION: I move to adopt Ordinance No. 4417, amending the Capital Facilities Element of the Comprehensive Plan by adopting the Puget Sound Regional Fire Authority’s 2022-2027 Capital Improvement Plan, including updating Fire Impact Fees. P. Property Tax Levy Ordinance - Adopt MOTION: I move to adopt Ordinance No. 4418, approving the property tax levy ordinance for the 2022 budget. Q. Cooperative Agreement with CDW-G for Computer Laptops, Monitors and Associated Accessories - Authorize MOTION: Authorize the City’s Information Technology Department to purchase technology supplies, materials, equipment, and software through cooperative purchasing agreement #AEPA-018A, between CDW Government, LLC and the King County Directors’ Association, a member of the Association of Educational Purchasing Agencies, if those purchases are within established budgets and made during the term of the cooperative agreement, which is currently in effect through February 28, 2022, and ratify all prior purchases under that cooperative agreement and consistent with this motion. R. 2022 Community Development Block Grant Annual Action Plan - Adopt MOTION: I move to adopt the Community Development Block Grant 2022 Annual Action Plan (including funding allocations and contingency plans) and authorize the Mayor to execute the appropriate certifications and agreements. 9. OTHER BUSINESS A. 2022 Mid-Biennium Budget Adjustment Ordinance - Adopt Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 8 of 10 Finance Director Paula Painter provided a brief overview of the Mid-Biennium Budget Adjustment process: The Mayor presented her proposed budget to Council on September 28th The proposed expenditure budget totals $421,309,650 and includes a $128,926,590 General Fund budget. The proposal also includes the use of fund balance within the General Fund of $1,700,180. This budget adjustment includes changes to operating and capital expenditures in addition to grant expenditures related to ARPA funding. Painter touched on the 2022 Highlights, including: Restore positions - Permit Center positions, Senior Center TLT position, Street Fund Engineer, ARPA - $500k for sidewalks, $200k for graffiti, $50k reduction for ANEW pre- apprenticeship program (budgeted in 2021), $100k for data collection system. Capital Additions: $4.74m funded by CRF, $120k funded by Criminal Justice, $686k for ShoWare Capital repairs/replacements. Troutner expressed appreciation of Painter and her Finance team, in additional to expressing appreciation of the Councilmembers. MOTION: I move to adopt Ordinance No. 4419, approving the 2022 Mid-Biennial Budget modifications. Kent Multi-Use Rezone Ordinance - Adopt (Quasi-Judicial) - Adopt City Attorney Pat Fitzpatrick provided a brief overview of the rezone, the process to date and indicated the matter is before the Council for final approval. This is a quasi-judicial matter. This is a request to rezone 4.48 acres of property located at 23703 Military Road South from Community Commercial to General Commercial. On October 13th, the Hearing Examiner recommended approval of the rezone. Fitzpatrick advised the Council of the Appearance of Fairness Doctrine and indicated the following questions will be asked in order to comply with the Doctrine. Fitzpatrick asked the following questions of all of the Councilmembers and any responses were noted by the Clerk: Kent City Council City Council Regular Meeting Minutes November 16, 2021 Kent, Washington Page 9 of 10 1. Do any of you have knowledge of having conducted business with the proponents or opponents of this rezone? The applicant is Raj Singh of RJSS, LLC. No Councilmembers answered “yes.” 2. Do any of you have any personal interest, financial or otherwise in the outcome of this proceed? No Councilmembers answered “yes.” 3. Do you live or own property within 300' of the site under consideration? No Councilmembers answered “yes.” 4. Do you have any reason to believe that you cannot consider this fairly and impartially? No Councilmembers answered “yes.” Fitzpatrick asked the members of the audience “Is there any member of the audience that has a lawful basis to ask for the recusal of a Councilmember due to this Appearance of Fairness Doctrine issue, if so, please state the name of the councilmember and the basis for that? No audience members responded. Fitzpatrick indicated that we have established by record that there is no conflict of interest. Planner, Sam Alcorn provided an overview of the Kent Multi-Use Rezone Ordinance and advised the Hearing Examiner and staff recommend approval of the rezone. Alcorn indicated the original intent of General Commercial zoning allows for more commercial uses and also advised of who received notice. MOTION: I move to adopt Ordinance No. 4420, approving the Kent Multi-Use Rezone application from CC (Community Commercial) to GC (General Commercial) and accepting the Findings, Conclusions, and Recommendation of the Hearing Examiner on the Kent Multi Use rezone application.
