ORDINANCE NO. 4431.
AN ORDINANCE of the City Council of the
City of Kent, Washington, vacating a portion of
Naden Street, also known as Naden Avenue, and
reserving an easement,
RECITALS
A. Chapter 35.79 RCW and Chapter 6.09 of the Kent city code
(*KCC') grant the City of Kent ("City") the power and authority to vacate
streets and alleys. Upon vacation, the property within the limits vacated
belongs to the abutting property owners, one-half to each.
B. On May L7,2022, the City Council of the City of Kent adopted
Resolution No, 2045 to initiate vacation proceedings for a portion of what
Was named "Naden Street" in 1910 by Ordinance No. 237, which runs
north to south from West Meeker Street. Currently, roadways running from
north to south within the City of Kent are referred to as "Avenues" and
consequently, this roadway is also known as "Naden Avenue." Throughout
this Ordinance, this roadway will be referred to as "Naden Street/Avenue."
In accordance with the requirements in state law and the KCC, this
Resolution fixed June 2L, 2022 as the time and date for a public hearing
and consideration of the street vacation and directed the City Clerk to
provide the required public notice.

C. The portion of Naden Street/Avenue to be vacated ("Vacation
Area") starts approximately at the southern border of King County Parcel
Numbers 2422049120 and 2422049103 and ends at the portion of Naden
Street/Avenue that the City acquired in fee simple from the Washington
State Department of Transpottation, Parcel No. 6000000063, and also
includes the alleyways running east-west, to the south of Parcel Numbers
2422049120 and 2422049703, totaling 39,179 square feet. The Vacation
Area is more particularly described and depicted in Exhibit A attached to
this Ordinance.
D. The City currently owns real property abutting the eastern
portion of the Vacation Area and one parcel abutting the western poftion of
the Vacation Area ("Naden Assemblage"). Vacation of this portion of Naden
Street/Avenue will connect the City-owned properties within the Naden
Assemblage and create one contiguous area to better accommodate future
development, This proposed vacation only impacts one parcel owned by a
private party-Parcel No. 2422049120. The City owns all other parcels
abutting the Vacation Area. Because of the public benefit derived from
vacating this portion of the roadway and connecting the parcels in the
Naden Assemblage, no monetary consideration for the vacation will be
required. Upon vacation, the property within the Vacation Area belongs to
the abutting property owners, one-half to each.
E. The vacation will not impact access to the Parcel Numbers
2422049120 and 2422049L2I because that portion of Naden
Street/Avenue serving those parcels is not included in the Vacation Area.
F. In the future, public access to the Naden Assemblage will be
via a new street on the easterly side of the Naden Assemblage, running

south from West Meeker Street to a new intersection allowing only right
turns from and onto Willis Street.
G. Public notice of the street vacation was provided in
accordance with Chapter 6.09 KCC. Specifically, the City posted written
notice in three public places within the City and on Naden Street/Avenue;
notice was published in the newspaper; notice was mailed to the propefty
owners abutting the Vacation Area; and notice was provided to the utility
companies.
H. For these reasons, after a public hearing and due
consideration, the City Council finds that vacation of this pottion of ,Naden
Street/Avenue will serve the public good, the streets are not required for
public access or public use, and the City has not received written
objections from owners of 50 percent of the property abutting the Vacation
Area.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
ORDINANCE
SECTION 7, - Findings of Fact. The above recitals are incorporated
by this reference as if fully set forth herein as findings of fact.
SECTION 2. - Street Vacation The City Council hereby vacates the
portion of Naden Street/Avenue starting approximately at the southern
border of King County Parcel Numbers 2422049L20 and 2422049103 and
ending at the portion of Naden Street/Avenue that the City acquired in fee
simple from the Washington State Department of Transportation, Parcel
No. 6000000063, and also including the alleyways running east-west, to

the south of Parcel Numbers 2422049120 and 2422049t03, as depicted
and legally described in Exhibit A, attached hereto and incorporated by
reference ("Vacation Area").
SECTION 3. - Reservation of Easements. There is hereby reserved
an easement by the City of Kent over the Vacation Area for the
installation, maintenance, repair, replacement, and use of utilities,
including electric, telecommunications, water and sewer ("City Easement")'
In addition, the City of Kent, its employees, agents, contractors, and
franchisees may enter the City Easement for these purposes.
SECTION 4, - Authorization By adopting this Ordinance, the City
Council hereby authorizes the Mayor to take all actions necessary to carry
out and effect the vacation, including executing any associated boundary
line adjustments and easements.
SECTION 5. - Recording. The City Clerk is directed to record a
certified copy of this ordinance with the King County Recorder's Office.
SECTION 6, - Severability. If any one or more section, subsection,
or sentence of this ordinance is held to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portion of this
ordinance and the same shall remain in full force and effect.
SESTION 7. - Corrections by city clerk or code Reviser. upon
approval of the city attorney, the city clerk and the code reviser are
authorized to make necessary corrections to this ordinance, including the
correction of clerical errors; ordinance, Section, or subsection numbering;
or references to other local, state, or federal laws, codes, ruleS, or
regulations.
