Hirschi indicated the City has entered into an agreement with the state Q
Department of Enterprise Services ("DES"), which allows the City to purchase
through contracts the state publicly bids and enters into with various a
vendors. The state has, in turn, entered into an agreement with a national o
purchasing cooperative, the NASPO Cooperative Purchasing Organization, N
LLC, doing business as NASPO ValuePoint, a 501(c)(3) limited liability o
company that is a subsidiary organization of the National Association of State N
r
Procurement Officials ("NASPO"). NASPO provides states, local governments,
public educational entities and other agencies with purchasing power that U-

allows them to leverage their spending through a single solicitation that °
obtains best value pricing and superior contract terms than the agencies 2
could do on their own. Purchases of software are exempt from competitive
bid requirements under KCC 3.70.110.D., as are purchases made through a
purchasing cooperative under KCC 3.70.110.F.
MOTION: I move to authorize the IT Department to purchase data a
communications products and services through the cooperative
purchasing agreement the state Department of Enterprise Services Q
has with Cisco Systems, Inc., if those purchases are within the City's a
established budgets and made during the term of the state contract,
which is in effect through September 30, 2024, but may be extended
through September 30, 2026, or later.

C. East Hill Police Substation - Lease Extension — Authorize
Police Commander, Andy Grove presented details on the lease extension
agreement with Kent Hill, LLC, for an additional 5-year term to maintain a

police substation on the East Hill and advised the purpose of this lease
extension agreement is to maintain the police substation on the East Hill. The
space has been leased in the Kent East Hill Shopping Center, located at
25635 104th Avenue S.E. since July 2016. While staff is working with the
Law Department to finalize the lease extension agreement, Council approval
is being sought for the Mayor to sign the agreement once all terms are
finalized. Although some minor provisions of the lease may change from
those in the attached draft, changes are not anticipated to change any
substantive provisions such as rental term or rental rate.
Grove indicated the rate is at market rate and this location is very beneficial c
due to the proximity to the high school and McDonalds.

Chief Padilla provided an update on the "Eight Can't Wait" initiatives as
follows:
1. Ban chokeholds and strangleholds.
HB 1054 prohibits the use of these techniques and the Kent Police
Department suspended the use of Lateral Vascular Neck Restrains prior to a
the enaction of new state law.
Q
2. Require de-escalation. r
The Kent Police Department has been and continues to require de-escalation
and reinforces it through annual training. The department will undergo
department-wide, required training - Patrol Tactics Course.
3. Require warning before shooting.
The Police follow the law and when feasible, issue a verbal warning. Not
every situation allows for a warning to be given without jeopardizing the
safety of officers and/or community members.
4. Exhaust all other means before shooting.
In addition to ongoing de-escalation training and practice, the Police
Department also trained and equipped officers to employ less lethal options

when the circumstances allow.
5. Duty to intervene.
The Kent Police Department had a policy in place before this requirement
became state law. Once the Criminal Justice Training Commission adopts the
model policy, Kent will revise their policy to be consistent with the model
policy.
6. Ban shooting at moving vehicles.
The Kent Police Department has a policy that prohibits shooting at all moving
vehicles in most circumstances. HB 1054 now regulates this and Kent follows c
the law.

7. Require use of force continuum. o
Chief Padilla advised this model is outdated and Kent has advanced beyond a
this academic approach by moving to a more comprehensive model that Q
requires officers to perform an assessment of several factors.

8. Require comprehensive reporting. o
The Kent Police Department requires that all use of force applications be N
reported in writing that is then reviewed for compliance with policy and law. o
Once the universal state reporting system is in place, Kent will configure their

systems to be in full compliance with the data reporting mandates.
