This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessarY to :
Omit Bid Items 1090 Chip Seal , tO92 Asphalt for Fog Seal, and 1094
Crack Sealing for the deletion of the chip sealing work scope on 124th
Ave SE. Add 15,250 SY to Bid Item 1110 Planing Bituminous Pavement
and 2,050 TON to Bid Item 1100 HMAfor Full Width Overlay Class 1/2"
PG 58V-22 for the addition of planing and overlay on L24th Ave SE.
Omit Bid Items 3090 Chip Seal , 3092 Asphalt for Fog Seal, and 3094
Crack Sealing for the deletion of the chip sealing work scope on Russell
Road. Add new Bid Items for 450 TON HMA for Full Width Overlay Class
L/2" pG 5BV-22 at $120.00/ToN and 80 sY Planing Bituminous
Pavement at $5.00/SY for the addition of planning and overlay on
Russell Road.

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all reguirements of this
Change Order by signing below. Also, pursuant to the above-referenced eontract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
aicepts that this Change Order constitutes final settlement of all claims of any kind or nature
arlslng from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract tlme, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, partlcularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any)'
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they arc
authorized to enter into this contract modlficatlon, which is binding on the pafties of this contract.
3. The Contractor will adJust the amount of its performance bond (if any) for this proiect
to be conslstent wlth the revised contract sum shown in section 2, above.

NEW PAY ITEMS I Notapplicable
e ommittance of chip sealing activities and the addition of planing a
location (124th Ave SE) and Sched III location (Russell Rd) are being made as a result of a value
review performed by City of Kent staff in partnership with the contractor to provide a more
ible lasting roadway. Field inspections of the existing roadway surface conditions resulted in the
scovery of a large quantity of roadway repairs necessary prior to the prescribed chip seal application
both locations. A comparison of the estimated chip seal and associated repair costs against the costs
a grind and oveday/inlay revealed that the extended life cycle of an overlay/inlay was beneficial,
espite the increased cost. Public Works Construction Engineering and Design Engineering, after
concurrence from Public Works Operations, proposed this value engineering change to
and it was agreed to proceed with thie change. The contractor has agreed to honor existing
item prices for the added quantitles and agreed to omit the chip seal scope of work.

Lakeside concurs with existing bid item pricing for planing and HMA for switching the chip seal to Grind and
lnlay/Overlay. lf we are directed to grind deeper that the 2 inch per planing bid item we would ask for the escalator to
deal with extra material.

As discussed, we are open to deleting the crack seal and chip seal portion of the Kent contract'
Despite our disappointment, I would like request to work with a hlgher-level engineer during the deslgn/scoping phase
of future projectsto assist wlth road selection determinations and discuss preservation options. lf used properly, chip
seal is the most cost efhctive road preservation treatment available.

There was -$118k of repairs not shown on the plans that would be necessary prior to chip
sealing.
Even if we stuck with the chip seal, there would be an extra -$118k of work needed ahead of
time. The repairs do not appear to be necessary prior to a girnd/inlay; the damage looks to be
top-down dela mination/cracking.
Chipseal = -$183k (per plan)
Repair necessary prior to chipseal = -$118k (overrun of existing bid items)
