NWC would offer the following information to why we don't believe the City's Special Provisions apply: 1. Asphalt Cost Increase—The scope of work has clearly changed from the original bid documents where this is not an increase or decrease in quantities issue as described in 1-04.4, rather it is a change in the means and methods of how the work is completed. Our subcontractor clearly has cost impacts above and beyond asphalt oil escalation due to the changes in their means and methods due to this design change. We need to make sure they are made whole due to the City's design change, so we are not willing to complete this work at unit pricing for the reasons listed above. 2. Crushed Rock—The bid item payment for the crushed rock under Section 4-04.5 is for supply, placement and grading only. Any support of our subcontractor and preparatory work including pulling match lines or touching up the grade ahead of paving operations to pave under traffic is incidental to Section 5-04 asphalt paving. We bid the project with our cost for paving under traffic included in the HMA, thus the reason we included this work in our forward pricing for the change order. Let us know if you would like to have a meeting to discuss this in more detail as we are just trying to ensure NWC and our subcontractors are whole when the project is done. I will prepare Change Order No. 1 to include provided costs for Extra Work (EW) items 1, 3, 5 and 6 in the amount of $25,706.63, including the 10 additional working days. The extra's associated with EW items 2 and 4B (Saturday premiums) will be tracked and accounted as work is scheduled and performed following FA guidelines. A summary change order capturing those extra's will be prepared once costs have been quantified. EW item 4A requesting a unit price adjustment of $185/ton to Bid Item 1095 is not approved. The City's position is Special Provision 1-04.4 Changes addresses increases and decreases to bid item quantities and Kent Special Provision 4-04.5 includes costs for finish grading under associated rock bid items. The City does recognize the escalation costs on asphalt oil from the time of bid and intends to adjust oil material costs per WSDOT's Escalation Clause spreadsheet (attached).
