by its signature waives any protest or claim it may have regarding this Amendment, and
ait<nowteiges and accepts thai ttris Amendment constitutes full payment and final settlement of
all claims of any kind or nature arising from or connected with any work either covered or
affected by this Amendment, including, without limitation, claims related to contract time,
contract acceleration, onsite or home office overhead, or lost profits. This Amendment, unless
otherwise provided, does not relieve the Consultant or Vendor from strict compliance with the
guarantee and warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if anY),
and this Amendment, prior to the effective date of this Rmendment, are hereby ratified and
affirmed, and the terms of the Agreement, previous Amendments (if anY), and this Amendment

WETLANDS
SCOPE OF WORK
CONTRACT NO. 4: Amendment 1
This scope of work includes a reinvestigation of the boundary of Wetlands A, B, G, and P for the
south 224thstreet Project (ENV-2005-6 #RPSA 2050224) in the city of Kent (city),
Washington. These witlands were originally delineated by ESA (Consultant) scientists in
October 2005. It is our understanding that these wetlands (and Wetland O) are within the current
project boundaries for phase I, and that other areas investigated in 2005 will be included in Phase
if. if." purpose of this work is to reinvestigate the boundaries of the wetlands and revise the
boundaries for the phase I project area if necessary, depending upon current site conditions. This
work shall include the following tasks described below.
Task 1: Wetlands A, B, G, and P Boundary Reinvestigation
The Consultant will conduct a wetland boundary determination of Wetlands A, B, G, and P.
prior to the field investigation, the Consultant will review project documentation (2006 ESA
wetland report) that is relevant to the wetland reinvestigation. Wetland conditions will be
identified based on field conditions at the time of the investigation by applying the wetland
determination method described in the U.S. Army Corps of Engineers Wetlands Delineation
Manual (Environmental Laboratory,1987) and the Regional Supplement to the Corps of
Enginee)s Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region (U.5.
a.ity Corps of Engineers, 2008). If the wetland boundary is found to significantly differ from
the btundary deliniated by the ionsultant in 2005, the boundary will be reflagged, and a sketch
map showing the approximate location of the wetland boundary will be provided to the City. The
City will survey any revised wetland boundaries.
Task 2: Wetland Report
The Consultant will provide a wetland report detailing the results of Wetlands A, B, G, O, and P
boundary reinvestigation. It is our understanding that these are the only wetlands within the
phase I project ur"u. Th" information in the 2006 wetland report will be used to describe the
wetlands, una *i[ be updated if the wetland boundaries differ fi'om the 2005 delineation andlor
site conditions have significantly changed. If the wetland boundaries are revised during the f,reld
investigation, the City-will recaiculate wetland and buffer impacts based upon the current project
design"and provide the new calculations to the Consultant for inclusion in the report. This
wetlind report will be considered an addendum to the September 2006 wetland report (ESA
2006). The report will include atable summarizing the cunent estimate of wetland and buffer
area impacts, based on information provided by the City-
Task 3: Prepare for and Attend Field Meeting
This task is described and budgeted under the original December 2010 contract. Task 3 will be
completed following completion of Tasks I and2.
Assumptions
o The 2005 wetland boundary will be reflagged by CrU surveyors prior to the Consultant's
site visit.
. All rights-of-entry tb the study area will be provided by the City prior to field work.
. Wetland boundary surveying, if necessary, will be conducted by the City.
. The City will be responsible for revisions to figures including wetland boundaries,
wetland and buffer impacts.
. The City will provide revised figures to the Consultant in pdf and AutoCAD format for
inclusion in the repoft.
. This scope of work does not include a stream survey or flagging of the ordinary high
water mark (OHWM) of streams.
o The City will provide area estimates for all wetland and buffer impacts, if the estimates
differ from those presented in the 2006 wetland report.
Schedule
The schedule outlined below assumes that the City provides approval of this scope of work by
September I,20ll.
Task Comnletion Date
Task I The Wetlands A, B, G, and P boundary reinvestigation field work will be
completed by Septemb er 9,2011, assuming that notice to proceed for this scope is
granted by Septembet l,20Il.
Task 2 The wetland reinvestigation technical memo will be submitted within two weeks
of completing the field work (if the wetland boundary is unchanged), or within
two weeks of receiving the revised wetland survey CAD data (if the wetland
boundary is revised).
Task 3 Anticipated to be in late September 2011, but depending upon date selected by the
Corps.
