This Change Order .amends the above-referenced contract; all other provisions of the
contract that arg' not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the pafties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equiPment necessarY to :
The plans call for the removal of curb and gutter between stations
48+85 and 51+85. There is an existing HMA sidewalk behind this curb,
which needed to be partially removed to form the new curb and gutter'
This existing HMA sidewalk was 3.5-4'wide and had deteriorated. Due
to the deterioration, the City determined it would be unlikely to remain
in a servicable condition after placing and compacting the new HMA' The
City elected to upgrade to cement concrete sidewalk to closer match the
City's standards and ease meeting ADA cross slope reqirements'
2. The contract amount and time for performance provisions of Section
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections L-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the contractor accepts all requirements of this-[rng" ordei by signing below. Also, pursuant to the above-referenced contract, contractor
agrees to waive any protest it may have regarding this Change order and acknowledges and
aicepts that this change order constitutes final settlement of all claims of any kind or nature
arising from or connecteld with any work either covered or affected by this Change order, including,
without limitation, claims related to contract time, contract acceleratibn, onsite or home office
overhead, or lost pioiit.. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance w'rih the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date'
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change orders (if any), and this Change order
shall be deemed to have aPPlied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.

approximately 53+00 LT, and a 24' length at approximately 54+75 RT.
o Clear and Grub/Grade as needed
o Alternate L: Restore with 4'wide section of HMA, 2" depth.
o Alternate 2: Restore with 4'wide section of Kent standard sidewalk.
Measurement and Payment:
o Provide a LS cost proposal for the HMA removal, clearing and grubbing, and grading. lnclude
detail sufficient to evaluate the proposal. Provide a price for HMA, and price for Conc. Sidewalk'
o Provide a per ton price for the 2" section of HMA, including compaction.
o Provide a per SY price for sidewalk, or indicate if existing unit pricing can be used.

We received the below pricing to replace the asphalt sidewalk on the North side of 212th where it
is below the current (and new) curb grade, We requested the contractor provide pricing for
replacing it in kind (HMA) in addition to an alternate price for replacing with Kent standard
concrete sidewalk, Here are the totals based on an estimated 300 LF:
- 2" Depth Asphalt (HMA) - $t2,765
- 4" Depth Concrete - $16,605
I like the idea of replacing this section of asphalt sidewalk with concrete but that comes with a
premium cost. In addition, please consider that there will be asphalt at each end of the new
concrete if we go that route.
please let me know your preference at your earliest convenience and we will get things moving
forward with our contractor. Let me know if you have any questions or need any additional
information.
