This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
The original schedule had this project being constructed in 2021. Due
to unforeseen conflicts with underground utilities the project had to be
redesigned. The redesign (Revision #1) and related City of SeaTac
permitting process pushed construction start to March of 2022. Due to
adjacent Kent School District scheduling challenges and revised roadway
restoration requirements, efficancies were lost and an additional Miles
S&G mobilization became necessary. The additional mobe allowed work
in front of the elementary school ADA driveway to be completed during
spring break. Cost of oil for HMA also increased during this time..
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement, which will
become effective on the last date written below.

I. Proposed Change
This Change Order provides compensation for Miles Sand & Gravel premiums related to oil cost
escalation, lost efficiencies of work and an additional mobilization related to Revision #1 changes as
summarized in NW Cascade Extra Work Action Request #8 dated 5/10/22.
II. Reason and Background for Change
The original schedule had this project being constructed in 2021. Due to unforeseen conflicts with
underground utilities the project had to be redesigned. The redesign (Revision #1) and related City of
SeaTac permitting process pushed construction start to March of 2022. Due to adjacent Kent School

Chris,
Due to splitting this up there was obviously a loss in production and in increased cost due to the smaller quantities
available per mobilization. We will have to agree on how many additional hours were required due to splitting this
up. Based on our daily crew cost(below)the cost for an asphalt paving crew and equipment is$960.31 per hour. Per
our request of$15.00/Ton for additional compensation that accounts for 3.3 hours @ the hourly rate of
960.31. According to our daily cost tracker program we spent an additional 4.3 hours @ 960.31/hr.

We feel that requesting the additional 3.3 hours @$960.31 for a total of$3,169.02 is a fair assessment of the cost due
to lost production.

Hi Chris,
The extra mobe to meet school demands is reasonable and the oil premium is justifiable, but
without a breakdown for the additional $15/ton requested, there will be no traction in the office.
Miles needs to illustrate how that amount was determined and how the revision caused it.

Jason, Jason, and I reviewed the attached Action Request #8 earlier this
afternoon. After discussion we are okay with the contractor's request for
compensation related to an additional mobilization for their paving
subcontractor, production impacts due to reduced daily quantities, and asphalt
cost escalations (calculated in accordance with WSDOT Standards).
In total we are (internally) in agreement with the contractor's request for a
change order in the amount of $8,868.60. This would conclude all of the
additional costs associated with Revision #1. Are you okay with proceeding
with a change order in this amount and closing out any additional impacts
related to Revision #1?
Please let me know if you have any questions or need any additional
information.

The purpose of this action request is to provide a paving breakdown proposal in an effort to make
our subcontractor Miles Resources whole.
Add tional MobilizA on: This is straight forward and is an additional equipment and materials
mobilization of$3,500.
Price gex Ton Preinim : NWC is proposing that an additional price per ton of$15.00 for Miles
portion of the work should be applied.The plan revisions, and the school requirements created an
additional mobe and partial shifts for Miles.Miles is union contractor,and has to pay their labor
based on the 2,4,6, 8 rule.NWC performed the patch backs and panel replacements to avoid an
increased number of Miles mobilizations. As such,Miles Resources feels the$15 per ton
premium is warranted.NWC is not applying this premium to any of the self-performed paving.
Asphklt Escalation:This was previously discussed and NWC has applied$6.57 per ton for the
211.75 tons that Miles paved. Zero markup is applied to this amount.
Please issue a change order in the amount of 8 8$ , 68.60 at your earliest convenience. If you would
