This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, Contractor shall provide all labor, materials, and
equipment necessary to :
Increase the unit price of bid item L245 to provide compensation for
lowering the existing monument castings and adjusted to grade. The
price is increasing $325 each, from $30 each to $355 each.
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections t-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including,
without limitation, claims related to contract time, contract acceleration, onsite or home office
overhead, or lost profits. This Change Order, unless otherwise provided, does not relieve the
Contractor from strict compliance with the guarantee and warranty provisions of the original
contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change Order
shall be deemed to have applied.
The pafties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project
to be consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement' which will
become effective on the last date written below.

Increase the unit price of bid item 1245 to provide compensation for lowering existing monument
castings and adjusting to grade. The price is increasing $325 per Each, from $30 Each to $355 Each
KSP 8-13.1 provides a description of work for Bid Item 1245 that includes a
sentence, written in bold, "The existing monument and casing shall not be disturbed." Because the
existing roadway grade is not rising, the addition of a riser necessitates the lowing of the monument
casing, disturbing it. The City confirmed the castings are to be adjusted down before installing the riser.

RFI Description: ln the project special provisions, section "8-13.L Monument Cases" explains that
"Existing Monument and Casing shall not be disturbed"
The Supplemental Construction Requirements in Section 8-13.3 describes the monument must be
lowered and re-adjusted to finish grade.
Please advise how you would like us to address monuments that do not match the new finish roadway
surface.

Lakeside lndustries Response to KBA/City of Kent
Cameron, as discussed in this RFl, Lakeside did not intend to perform an adjustment of the existing
monument case/housing. We bid item# 1245 with the intent to furnish a riser and place it on top of the
existing monument case and not disturb the existing case location or elevation. Per your response
above, we will need to disturb the case when lowering and installing a new riser. This essentially is a full
monument case/housing adjustment which takes significantly more time and resources than simply
adding a riser. We will have to jack hammer, excavate asphalt and excess dirt, adjust to finish elevation
and patch with asphalt. This is very comparable to Bid item L250 (Replace Existing Valve Box Top Section
and Lid and adjust to finished grade) with the exception of purchasing the valve box top and valve lid.
Bid price for item 1250 is 5425/Each. Deducting the cost of the valve box and lid (Highlighted below)
reduces the price to approx. S325/Each, then adding the 530 for each riser lands at 5355/Monument
Adjustment. I am proposing a change to increase bid item 1245to S355/Each.
