This Amendment is made between the City and the above-referenced Consultant or Vendor
and amends the original Agreement and all prior Amendments. All other provisions of the original
Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force
and effect. For valuable consideration and by mutual consent of the parties, Consultant or
Vendor’s work is modified as follows:
1. Section I of the Agreement, entitled “Description of Work,” is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, the Consultant or Vendor shall:
Provide additional geotechnical investigation and coordination
services and extend contract duration.
2. The contract amount and time for performance provisions of Section II “Time of
Completion,” and Section III, “Compensation,” are modified as follows:

The Consultant or Vendor accepts all requirements of this Amendment by signing below, by
its signature waives any protest or claim it may have regarding this Amendment, and
acknowledges and accepts that this Amendment constitutes full payment and final settlement of
all claims of any kind or nature arising from or connected with any work either covered or affected
by this Amendment, including, without limitation, claims related to contract time, contract
acceleration, onsite or home office overhead, or lost profits. This Amendment, unless otherwise
provided, does not relieve the Consultant or Vendor from strict compliance with the guarantee and
warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if any), and
this Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed,
and the terms of the Agreement, previous Amendments (if any), and this Amendment shall be
deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are

Thank you for the opportunity for the extra service to this important downtown park.
After field work by JAB during the 60% design phase it became apparent an underground gas
utility line was not picked up by Survey, as the gas utility locate was not provided at the time of
Survey performing the field work. This required some additional coordination with Survey and
locate service to be on site to pick up the Gas line. To expedite the work JAB provided initial
PSE Gas utility coordination to verify and confirm the gas line; including filling out request
forms to verify the utility and meeting on site. This resulted in it becoming apparent the gas line
had no easement to be on the park property. Parks is currently working with PSE to remedy the
utility easement on the park property and relocate the gas line to avoid any potential conflicts
with the proposed park design improvement.
The city pre-application summary is requesting that geo-tech work support the infiltration needs
for feasibility assessment for permeable paving as a BMP stormwater solution to the site. This
requires additional work from Geo-engineers to provide infiltration rate analysis to support Civil.
This Extra service work will be billed under the existing Task B – Site Inventory and Analysis.
Task A – Administration/ Coordination
Minor time to coordinate with City and Design team members and prepare invoicing.

Additional field work and investigation has been required for survey and Geotech.
Additional Geotechnical investigation by Geoengineers
The purpose of our additional services is to use laboratory data collected in our initial study at
the project site and our experience to provide an infiltration estimate of native site soils. Based
on discussions with you and the project civil engineer (LPD Engineering PLLC), it is our
understanding that permeable paver best management practices (BMPs) are planned for the
project. We understand that design of the permeable pavers requires a design infiltration rate.
In our Geotechnical Report for the project dated March 29, 2021, we concluded that on-site
facilities requiring full infiltration were likely infeasible due to relatively shallow groundwater at
the site (on the order of 5 feet below ground surface). It is our understanding that the proposed
BMPs will be on the order of 12 inches deep and will not require full infiltration. We anticipate
that a design infiltration rate can be provided based on information from nearby studies and grain
size correlations of soil samples collected in our initial study. However, if these infiltration
BMPs will require full infiltration, we anticipate that additional field studies (i.e. Pilot Infiltration
Tests [PITs]) would need to be performed in accordance with the City of Kent Surface Water
Design Manual (SWDM).
Our specific scope of additional services will consist of the following:
1. Review existing soil information collected from our previous study at the site.
2. Use particle-size gradation analyses results from our previous study and nearby infiltration
data from other sites to provide a design infiltration rate of native site soils for design of the
proposed BMPs.
3. Prepare an addendum to our geotechnical report presenting our findings, conclusions and
recommendations.

EXTRA SERVICE SCOPE ASSUMPTIONS:
1. Survey of new gas location after PSE relocate is not included.
2. Geo-Engineers scope and budget does not include any construction management,
monitoring, inspections or Pilot Infiltration Tests (PITs). We will provide a scope and
budget for these services as needed and upon request.
