Yes No Dir Asst: Sup/Mgr: Dir/Dep: rev. 20210513 FOR CITY OF KENT OFFICIAL USE ONLY Agreement Routing Form For Approvals, Signatures and Records Management (Optional) Basis for Selection of Contractor: * Memo to Mayor must be attached Termination Date: Authorized to Sign: THIRD AMENDMENT TO PURCHASE AND SALE AGREEMENT Page 1 of 1 THIRD AMENDMENT TO REAL ESTATE PURCHASE AND SALE AGREEMENT WITH EARNEST MONEY PROVISION This Third Amendment (“Third Amendment”) is part of the Purchase and Sale Agreement dated May 11, 2021, the First Amendment dated June 17, 2021, and the Second Amendment dated November 1, 2021 (the “Agreement”), between the CITY OF KENT, a Washington municipal corporation (“Buyer”), and ROBERT AND SALLY MENDEL (“Seller”), regarding the sale of property commonly known as 10028 SE 267th Street, Kent, WA 98030 (the “Property”). IT IS AGREED BETWEEN THE BUYER AND SELLER AS FOLLOWS: 1. References in the First Amendment and Second Amendment to “Robert and Sally Mendel LLC” were in error. Sellers are husband and wife, not an entity. All references to Seller in the First and Second Amendment shall mean “Robert and Sally Mendel.” 2. In the Second Amendment, the parties waived any requirement of Seller to inspect and/or pump the on-site sewage system that serves the house on the Property. By their signatures below, the parties agree to release and hold Rainier Title harmless from any loss or liability that it incurs in closing without inspection or pumping of the on-site sewage system. 3. All other terms and conditions of the Agreement remain unchanged. IN WITNESS WHEREOF, the parties hereto have executed this Amendment on the date set forth below.
