RE: Summit Structures of Washington, LLC - Construction of Utility Sheds
Dear Mr. Shrock:
This letter memorializes that the City of Kent (“City”) and Summit Structures of Washington, LLC
(“Summit”) have mutually agreed to the immediate termination of their Public Works Agreement
(“Agreement”), dated November 11, 2021 concerning the construction of a utility shed at Hogan
Park at Russell Road. Both parties’ performance under that Agreement is excused without penalty
or liability to the other party.
Pursuant to Section II of the Agreement, the parties agreed that all physical work outlined in the
Agreement would be completed by December 31, 2021. On December 6, 2021, the City received
an email from Summit stating that this project could not be completed by the end of the year.
In accordance with Section Five (V) of the Agreement, the City may terminate the Agreement for
good cause, including the Contractor’s failure to complete the work within the time specified in
the Agreement.
