SECOND AMENDMENT TO REAL ESTATE PURCHASE AND SALE AGREEMENT
WITH EARNEST MONEY PROVISION
This Second Amendment ("Second Amendment") is part of the Purchase and Sale
Agreement dated May 11, 2021 and the First Amendment dated June 17, 2021 (the
"Agreement"), between the CITY OF KENT, a Washington municipal corporation ("Buyer"),
and ROBERT AND SALLY MENDEL LLC ("Seller") regarding the sale of property commonly
known as 10028 SE 267th Street, Kent, WA 98030 (the "Property").
IT IS AGREED BETWEEN THE BUYER AND SELLER AS FOLLOWS:
1. Given that Buyer intends to demolish the house on the Property at some point
after Closing, Buyer hereby waives any requirement to inspect and/or pump the On -site
Sewage System (OSS) that serves the house on the Property. Seller shall not be required to
do either prior to Closing.
2. All other terms and conditions of the Agreement remain unchanged.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment on the date
set forth below.
