All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor’s work is modified as follows: 1. Section I of the Agreement, entitled “Description of Work,” is hereby modified to add additional work or revise existing work as follows: In addition to work required under the original Agreement and any prior Amendments, the Consultant or Vendor shall: As described in attached Exhibit A, incorporated herein, consultant shall provide additional services for permitting due to increased scope of the project. 2. These improvements have moved beyond “maintenance” and will require permitting for grading and drainage and all of the associated analysis, design and reporting. In total, this additional services request is $42,100 plus an option task ($31,000) dependent on the outcome of initial storm drainage and geotechnical analysis. This request is compromised of the following components: Increased Maximum Allowable Construction Costs (MACC) The original proposal was based on an assumed MACC between $500,000 and $750,000. Recent conversations with Terry suggest the MACC will increase beyond $750,000 and likely include addition of bid alternates (or additives). Modest additional services are proposed to account for the more involved documentation associated with a larger scale of project. Permitting (including drainage design and reporting) The increased scale of the proposed improvements will also require obtaining construction permits, including preparation of a TIR. This proposal includes engineering and design services to determine feasibility of incorporating new surfaces (and code) into the existing stormwater management systems. Services provided by Site Workshop (LA), KPFF (civil) and GeoEngineers (Geotech). Stormwater Flow Control (OPTIONAL task valued at $31,000) Should the existing stormwater facility prove inadequate to meet the requirements of this project and the current code, stormwater flow control will be required. This proposal includes services to provide additional analysis, design and documentation.
