As of the date of this letter, no work has been completed under this original contract and no payment has been made. Given the period of time that has transpired, PSE and the City have decided to enter into a new contract to cover the scope of work outlined in the original contract. For this reason, this letter serves as formal notice of the City’s termination of the original contract in order to avoid duplication. Both parties’ performance under the original contract is excused without penalty or liability to the other party.
