RE: Lake Fenwick Aerator Improvements
To Whom it may concern:
Puget Sound Energy (“PSE”) and the City of Kent (the “City”) entered into a Commercial
Facilities Contract on February 9, 2021 (“original contract”), for PSE to upgrade a transformer
near Lake Fenwick in order to supply more power to an upgraded aerator. As of the date of this
letter, no work has been completed under this original contract and no payment has been
made.
Given the period of time that has transpired, PSE and the City have decided to enter into a new
contract to cover the scope of work outlined in the original contract. For this reason, this letter
serves as formal notice of the City’s termination of the original contract in order to avoid
duplication. Both parties’ performance under the original contract is excused without penalty or
liability to the other party.
If you have any questions regarding the termination of the original contract, please feel free to
contact me.
Thank you,
Sincerely,
_______________
