MEMORANDUM OF AGREEMENT

KENT POLICE OFFICERS ASSOCIATION
Representing the
POLICE SERGEANTS AND OFFTCERS
Regarding
Section L7.L2 Bilingual PaY
This Memorandum of Agreement ("MOA") is entered into by and between the City
of Kent ("the City") and the Kent Police Officers Association, representing the Police
Sergeanis and Officers' bargaining unit (referred to herein as "KPOA"), to amend
Section L7.L2 of the collective bargaining agreement ("CBA").
Backoround
The City and the KPOA are parties to a collective bargaining agreement ("CBA")
effective January L, 2OL9, through December 3L, 2O2L-
Employee proficiency in languages other than English improves resident access to
vital City services. Additionally, offering pay incentives to employees for their non-
English language proficiency aids in the recruitment of a diverse candidate pool,
which further leads to a more inclusive workforce that reflects the City's diverse
population.
Currently, Section L7.L2 of the parties' CBA recognizes those individuals who are
additionally proficient in a language other than English by providing them with a
pay incentive of 9100 per month in recognition of their efforts to maintain those
ianguage skills. This incentive is a flat-rate that is provided to all bilingual or
muitilingual employees, irrespective of the degree of proficiency each employee
possesses.
While some employees possess a level of proficiency adequate to navigate simple
contacts with the community, other employees possess high-level, high-demand
non-English language proficiency, These employees are regularly regarded as
expertJand are called upon to translate on-scene, to assist detectives, or to testify
in court.
The parties agree that, in an effort to recognize those employees who possess
advanced non-English language skills, the incentive pay should better reflect the
benefit these advanced skills confer on the Kent community and the City' This MOA

formally amends the pay incentive provided for in Section t7.LZ of the CBA to
reward advanced non-English language proficiency.
Aoreement
The parties agree as follows:
1. Section t7.L2 of the CBA is amended as follows:
Section 17.12. Bilinqual Pay
The City recognizes the benefits of bilingual skills.Two pav incentives
discretion:
1 The language(s) and level of proficiency each employee must
attain to be eligible for bilingual pay at both the one-hun
dollar ($100) base level and the 3olo advanced level;2. The testing or methodology used to determine proficiency; and3. The number of bilingual officers (in each quarifying ranguage)
needed by the department.
Ease Bilingual Pay. Employees eligible for bilinguar pay, as approved by
the Police chief, shall receive one hundred dollars ($100.00) per monthin recognition of their non-English language skills This is the base
incentive payment is provided irrespective of how many additional non-
English languages an employee is proficient in.

1. Until December 31, 2021, an employee may test their

The provisions of this MOA will be incorporated into the parties' new CBA for
2022 - 2024, which the parties are currently negotiating.
All other language of the CBA shall remain in full force and effect and shall
not be altered by this MOA,
4. This MOA was prepared and/or reviewed by both parties. In the event of an
ambiguity in any term of this MOA, it shall be interpreted evenly, and not
against the drafter of the MOA. The principle of contra proferentem shall not
apply.
By signing below, the parties agree that the above represents the parties'full and
