1. Resolution to Adopt a Template Small Cell Master License
Agreement - Adopt
Assistant City Attorney, Christina Schuck presented details on the Resolution
to adopt a template for the Small Cell Master License Agreements.
Tonight’s presentation is seeking authorization for small cells on city
lights (city-owned poles). The Master License Agreement is how the
deployment is authorized - an umbrella agreement licensing use of street
lights under specific terms.
A Site License Addendum will be needed for each location.
Staff is recommending 10-year term for the MLA. This is longer than the

5-year franchises because carriers will need to make significant
investments.
Rent will be $270 per pole, per year (this amount is determined by the
2018 FCC order).
There is an alternate rent provision in the MLA that allows for changes in
the event the FCC order is overturned.
All deployments must adhere to design guidelines:
• Remove & replace existing pole
• Height, internal wiring, antennas and equipment at top of pole
City Protections in the agreement:
• Carriers install, maintain, repair and relocate
• Hold harmless and insurance bonds
Council advised providing pre-construction notice one week prior to
construction to those within a 100-foot radius of the pole is reasonable.
Staff recommends moving forward with adopting a template MLA.
Benefits include:
• Streamlines the process
• Allows administrative execution of the MLA if carriers agree to use the
template
• Helps meet FCC 60 and 90-day shot clocks
• Helps meet Federal law - treating carriers the same
If material changes are made to MLA, staff will need to return to Council
for approval.
Schuck confirmed the carriers will be responsible for making any
necessary repairs to poles.
All poles will look different but need to follow the same design guidelines.
Schuck provided the council with some of the guidelines found in Chapter
6.16 of the Kent City Code relating to Utility Design Standards in the
Right-of-Way
MOTION: Adopt Resolution No. 2007, approving a small cell
Master License Agreement template and authorizing the
execution of individual Master License Agreements with
qualified applicants administratively.

2. Payment of Bills
The payment of bills was presented to the City Council.
MOTION: Approve the payment of bills received through
January 15, 2020 and paid on January 15, 2020 and approve
the checks issued for payroll for January 1, 2020 through
January 15, 2020 and paid on January 17, 2020.
