ORIGINAL AGREEMENT DATE: 11/30/2017
This Amendment is made between the City and the above-referenced Consultant or Vendor
and amends the original Agreement and all prior Amendments. All other provisions of the original
Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force
and effect. For valuable consideration and by mutual consent of the parties, Consultant or
Vendor’s work is modified as follows:
1.Section I of the Agreement, entitled “Description of Work,” is hereby modified to add
additional work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments, the Consultant or Vendor shall:
Provide additional construction administration services
including futsal field modification and structural review and
Diego Moreno Memorial coordination.
2.The contract amount and time for performance provisions of Section II “Time of
Completion,” and Section III, “Compensation,” are modified as follows:

The Consultant or Vendor accepts all requirements of this Amendment by signing below, by
its signature waives any protest or claim it may have regarding this Amendment, and
acknowledges and accepts that this Amendment constitutes full payment and final settlement of
all claims of any kind or nature arising from or connected with any work either covered or affected
by this Amendment, including, without limitation, claims related to contract time, contract
acceleration, onsite or home office overhead, or lost profits. This Amendment, unless otherwise
provided, does not relieve the Consultant or Vendor from strict compliance with the guarantee and
warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if any), and
this Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed,
and the terms of the Agreement, previous Amendments (if any), and this Amendment shall be
deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this Amendment, which is binding on the parties of this contract.

Proposal for Landscape Architectural Services – Extended Construction Administration
services and Memorial Design
Terry:
With the added Futsal coordination and additional Plaque design coordination, we have
identified a need for additional services in order to continue with our construction
support services for West Fenwick Park. As of end of May we have expended our
original fees, and have estimated fees for the duration of construction anticipated to be
complete in mid-August.
We have broken down tasks within this scope letter for Futsal Coordination,
Construction Administration Finalization, and Memorial Finalization. Detailed information
is included below reflecting our current understanding of the work needed for
finalization.
This letter outlines our proposed landscape architectural services to complete the tasks
on site. We are looking forward to completing this project with you!
Futsal Coordination $6,590.00
Issues identified in the West Fenwick back punch have led to unanticipated
coordination between TDI, Berger, Kompan, and the City team. The fees identified
below include work to date on this item and the following work anticipated to complete
the Futsal Court:
(1) site visit to coordinate work plan, documentation
Additional coordination during work
(1) punch walk and documentation, that coincides with memorial
plinth/plaque/arch punch.
Construction Administration Finalization $1,145.00
The fees identified below are estimated based on work to date. Tasks include the
following:

(1) One punch list and (1) one back punch, potentially including back punch for
memorial and futsal work if needed.
Playground dot layout plan for paint reapplication
Memorial Finalization $4,335.00
We are excited with the opportunity to finalize the memorial for Diego Moreno at the
Futsal Court. The following tasks are included as part of the design effort:
Design layout (previously assumed by City) for the bronze plaque. Text for
inclusion coordinated by the City.
ID Vendor for bronze plaque, coordinate detailing, production, and cost
estimating with Vendor/City. City to coordinate delivery and coordinate/pay
vendor invoice.
Construction support is assumed to include coordination of delivery of stone
plinth, plinth/plaque coordination, and a punch walk and documentation for
plinth/plaque/arch that coincides with punch for futsal work. No additional
visits to Marenakos are anticipated.
Fees
Based on the scope of services identified at this time, we have established a fee of
$12,070 for landscape architectural services. Fees will be billed monthly based upon
the percentage of work completed. Services beyond those noted in this proposal will be
billed as additional services on an hourly basis as follows:
Principal $185.00 per hour
Associate $164.00 per hour
Project Manager $120.00 per hour
Landscape Designer $95.00 per hour
Administrative Staff $95.00 per hour
