The above-referenced agreement is scheduled to expire on December 31, 2008.
pursuant to Section 1 of said agreement, this letter shall serve as notice of AboveNet's
intent to renew for an additional five (5) year term. AboveNet is willing to renew on the
same terms and conditions as the initial agreement'
